ORD 77-21 LICENSING OF CERTAIN TYPES OF BUSINESSESAN ORDINA~CE OF THE CITY OF WINSLOW, WASHINGTON, AMENDING
ORDINANCE 75-1 WHICH PROVIDES FOR THE LICENSING OF CERTAIN
TYPES OF BUSINESSES AND OCCUPATIONS AND IMPOSE A BUSINESS
TAX THEREON.
The City Council of the City of P!inslow do ordain as follows:
Section 15 of Ordinance 75-1 as amended by Ordinance 75-8
is further amended to read as follows:
SECTIOn] 15. REVOCATION OF BUSINESS LICENSE. Any
license issued pursuant to this ordinance may be revoked
by the City of Winslow, for a cause, in the event the holder
thereof is convicted by a court of competent jurisdiction of
violating any other ordinances of the City of I~inslow or laws
of the State of Washington or fails to pay the annual license
fee and/or annual tax together with any penalties due thereon
within six months after said sum is due and owing° No
revocation of license shall be made unless the Winslow
Hearing Examiner shall have held an administrative public
hearing pursuant to Section 7 of Ordinance 76-.19 as amended.
The licensee shall be given at least 20 days notice of the
public hearing in writing by mailing to the address listed
on the license application. Following the public hearing
and revocation, and upon proof satisfactory to the Hearing
Examiner that (1) the licensee has been convicted of a
violation of a Winslow city ordinance, a law of the State
of Washington, or has failed to pay the annual license fee
and/or annual tax or any penalties due thereon, and (2) that
the business license should be revoked, the applicant shall
cease doing business within the City of Winslow. An
appeal pursuant to the procedures set forth in paragraph
7 (a) of ordinance 76-19, as amended, shall stay revocation
of the business license until a final decision has been
rendered.
There is added to Ordinance 75-1 as amended by Ordinance
75-8 a new section to read as follows:
Section 21. CIVIL PE~ALTY. In the event any person
fails to pay the license and/or tax imposed by this ordinance
by the due date, a civil penalty shall be imposed as follows:
10% of the delinquent license fee and/or tax times the
number of months delinquent. A fraction of a month shall be
deemed a full month.
PASSED by the City Council of the City of Winslow on the
/7~ day of October, 1977 and this ordinance shall become
effective five (5) days after its publication or posting in the
manner required by law.
