AN ORDINANCE relating to penalties to be imposed
for parking violations within the City of Winslow;
defining specific parking restrictions and requirements;
providng a procedure for imposing penalties for viola-
tion thereof; and repealing Ordinances 128 and 75-5
THE CITY COUNCIL OF THE CITY OF WINSLOW DO ORDIN AS FOLLOWS:
1. Definitions. The following definitions shall be applicable
to the provisions of this ordinance:
a. "Back-In Only" shall mean all vehicles must park backed in
any area designated as a back-in only parking area.
b. "Loading Zone" shall mean any zone designated specifically
for the loading and unloading of passengers from a motor vehicle.
c. "Illegal Parking" shall mean the parking of any vehicle in
an area or along the street where no parking at any time is permitted~
d. "Impeding Traffic" shall mean the parking of a motor vehicle
in such a manner as to obstruct or stop the passage of other vehicles.
e. "Improper Parking" shall mean the parking of a vehicle in an
area or space where parking is permitted, in such a manner as to
obstruct the passage of other vehicles or pedestrians, or the parking of
a vehicle in an area where parking places are designated by lines or
marks in such a manner that said vehicle is across any such line or
mark, or is not within the area so designated by such lines or markings.
f. "No Parking Zone" shall mean a zone designated so as to permit
no parking of any motor vehicle at any time, or at specified times.
g. "Restricted Commuter" shall mean that no vehicle may be allowed
to park in an area that is designated as "Restricted Commuter" before
9:00 a.m. without a properly displayed and valid car pool permit.
h. "Restricted 4:30 - 6:00 p.m." shall mean that no vehicles shall
park in such an area designated as such after 4:30 p.m. or before 6:00 p
i. "Restricted 6:00 - 9:00 a.m." shall mean that no vehicles shall
be allowed to park in a designated area after 6:00 a.m. or before 9:00a.
j. "Wrong side" shall mean the parking of any vehicle in a
designated or undersignated parking space on the side of a street
with the vehicle facing on-coming taffic.
2. Penalties. It shall be unlawful for any person to permit or allow
a motor vehicle to be parked in violation of any of the above designated
areas or beyond any posted time limits for parking of motor vehicles.
The penalty for violation of any of the provisions of this ordinance
shall be $5.00 for each such violation and the motor vehicle shall be
issued a parking violation notice in the form prescribed by the City
Clerk which shall be paid to the City of Winslow. The above penalty
of $5.00 per violation shall apply only if the penalty is paid within
seven (7) days from the issuance of the notice of violation. Payment
shall be deemed made if the penalty is either (1) delivered to the
Clerk-Treasurer of the City of Winslow at the Winslow City Hall,
(2) placed in the United States mail with proper postage affixed and
addressed to City of Winslow, P. O. Box 10100, Winslow, Washington 98110
or (3) deposited in a proper collection box provided for such purposes
by the City of Winslow. In the event the penalty is not paid within
seven days from the date of issuance, the penalty shall be increased
to $10.00 per violation. In the event the penalty is not paid within
thirty (30) days after the issuance of the notice of violation, the
matter shall be referred to the Winslow Municipal Court for prosecution
and a Summons will be issued. Upon conviction by the Municipal Court
of a violation of this ordinance, the penalty shall be not less that
$10.00 per violation, nor more than $25.00 for each such violation.
3. Registered Owner's Responsibility. Every person in whose name
a vehicle is registered or licensed shall be responsible for all
parking violations under this ordinance.
4. Repealer. Ordinance No. 128 and 75-5 and all other ordinances
or parts thereof in conflict herewith as regards the parking of
vehicles are hereby deemed repealed.
This Ordinance shall take effect five (5) days after its
passage by the City Council of Winslow and its posting of publication
in the manner required by law.
