ORD 78-21 PARKS AND RECREATIONAL FACILITIESORDINANCE NO. 78 - 21 AN ORDINANCE OF THE CITY OF WINSLOW RELATING TO PARKS AND RECREATIONAL FACILITIES, ESTABLISHING A BOARD OF PARK COMMISSIONERS, AND BINDING THE BOARD'S POWERS AND DUTIES. THE CITv COUNCIL OF THE CITY OF WINSLOW do ordain as follows: SECTION 1. Definitions. Words used herein shall be defined as follows: 1. "Park" means an area of land used for public recreational purposes, including landscape tracts, picnic grounds, playground~ athletic fields, recreational centers, recreational trails and pathways, and all other recreational facilities for the use and benefit of the public, including municipal buildings so used. 2. "Board" means Board of Park Commissioners. SECTION 2. Board of Park Commissioners. Five (5) Park Commissioners sha2 constitute the Board of Park Commissioners three (3) of whom shall be residents of the City of Winslow. Commissioners shall be appointed by tt Mayor, with the approval of the majority of all members of the City Council, and shall serve for a term of three (3) years each, without compensation. The first members shall serve staggered terms, of one for one year, two for two years and two-r for three years respectively, which shall be determined by the Mayor at the time of appointment. Each year the Mayor shall, subject to the Council confirmation, appoint the successor of the Commissioner whose term of office expires. Appointments to fill vacancies shall be before the unexpired term. The Commissioners shall each year organize the Board and select one of their members to serve as Chairman, which member shall have at least one year remaining to serve on the Board. SECTION 3. Commissioners; Removal; Vacancies. The Mayor may, with the consent of the City Council, remove without cause any Commissioner. The vacancy thereby created shall be filled by appointment of the mayor with the approval of the majority of all members of the City Council. A member thus appointed shall serve for the remainder of the term. SECTION 4. Board Meetings, Officers, Quorum. The Board shall hold regular monthly meetings at a specified time and day as may be determined by majority vote, and in addition may hold special meetings at such times as may be called by the Chairman of the Board by written notice to each member of the Board at least twelve (12) hours before the specified time for the proposed meeting. All meetings shall be opened to the public and subject to the Open Public Meetings Law of the State of Washington, RCW Meetings of the Board shall be presided over by the Chairman, if present, or by a member of the Board selected by a majority of the Board members at such meeting. At all meetings of the Board, a majority of the Board shall constitute a quorum for the transaction of business, and a majority vote of those present shall be necessary to carry any proposition. One member of the Board shall be designated Secretary and shall keep accurate minutes of all proceedings, the original of which shall be filed promptly after approval by the Board with the City Clerk. SECTION 5. Powers and Duties of the Board. The Board is hereby authorized and empowered to make rules and regulations necessary for the conduct of its business, which rules and regulations shall be public records on file with the City Clerk. The Board shall be advisory to the City Council regarding the general supervision and control of parks and recreational facilities within the City of Winslow. The Board shall have the general power to advise the City Council regarding the establishment of a park and/or recreation department, and regarding the employment of necessary personnel, and to advise regarding conduct of any form of recreation or cultural activity and shall advise regarding control and supervision of all parks belonging to the City, and advise regarding planning, promotion, management and acquisition, construction development, maintainence and operation, including restriction on and compensation to be paid for, municipally owned recreational facilities, including community buildings and improvement and ornamentation of the same, and shall make recommendations regarding into written contracts. The Board is specifically empowered to prepare a Comprehensive Park Plan for the City of Winslow which, when adopted by the City Council, shall set fourth the future park and recreation requirements of the City of Winslow. The Board shall prepare and recommend to the City Council standards for dedication of land within plats, subdivisiol and planned unit developments for park and recreational purposes and recommend a formula to allow payments by developers to the City in lieu of dedication of land for park and recreational purposes. to the City r e . -. . an estimate of the amount of money required to carry on its activities for the ensuing year, together with recommendations for the development of programs and facilities as it may deem advisable, the information for guidance of the City Council in preparing the budget for the next years operation. The Board shall prepare up recommended rules of conduct govering activities within Winslow Municipal parks which shall be submitted to the City Council and when adopted by Ordinance be enforced by the Winslow Police Department. SECTION 7. Effective Date. This Ordinance shall be in full force and effective five (5) days after its passage, approval and publication or posting in the mmner required by law.
