ORD 78-28 UNIFORM BUILDING CODECITY OF WINSLOW ORDINANCE NO. 78 - 28 AN ORDINANCE OF THE CITY OF WINSLOW ADOPTING BY REFERENCE THE UNIFORM BUILDING CODE (1976 ADDITION), UNIFORM BUILDING CODE STANDARDS (1976 ADDITION), UNIFORM PLUMBING CODE (1976 ADDITION), UNIFORM MECHANICAL CODE (1976 ADDITION), UNIFORM FIRE CODE (1976 ADDITION), UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS (1976 ADDITION) AND REGULATIONS FOR BARRIER FREE FACILITIES AS PUBLISHED BY THE WASHINGTON STATE BUILDING CODE ADVISORY COUNCIL ON OCTOBER 1, 1976, THERMAL EFFICIENCY STANDARDS, PURSUANT TO H.B. 98 (RCW 19.27) AS PUBLISHED BY THE WASHINGTON STATE ENERGY OFFICE, AMENDING SAID CODES AND ESTABLISHING FEES FOR INSPECTION AND ESTABLISHING PENALTIES FOR VIOLATION THEREOFt AND REPEALING ORDINANCE 77-13 ~D 75-3. THE CITY COUNCIL of the City of Winslow do ordain as follows: SECTION 1. TITLE: This Ordinance shall be known as the City of Winslow Building Code. SECTION 2. CODES ADOPTED BY REFERENCE: The following codes are hereby adopted by reference subject to modifications and/or amendments set forth in Sections 3 through 5. Uniform Building Code and Standards(1976 Edition) including appendices as prepared by the International Conference of Building Officials. Uniform Plumbing Code (1976 Edition) as prepared by the International Associaton of Plumbing and Mechanical Officials. Uniform Mechanical Code (1976 prepared by the International Building Officials. Edition) as Conference of Uniform Fire Code (1976 Edition) as prepared by the International Conference of Building Officials and Western Fire Chiefs Association. Uniform Code for the Abatement of Dangerous Buildings (1976 Edition) as prepared by the International Conference of Building Officials. The Regulations for Barrier Free Facilities as published by the Washington State Building Code Advisory Council on October 1, 1976. Thermal Efficiency Standards Pursurant to H.B. 98 (RCW 19.27) as published by The Washington State Energy Office. In case of conflict among codes adopted for subsections b, c, & d; the Code adopted per subsection (a) shall govern over those adopted in subsection b, c, & d. SECTION 3. AMENDMENTS TO THE UNIFORM BUILDING CODE: Section 204 of the Uniform Building Code (1976 Edition) is deemed to read as follows: In order to determine the suitability of alternative materials and methods of construction and to provide for reasonable interpretations of the provisions of this Code, the initial determination shall be made by the Building Official., which shall be final unless appealed to the Winslow Hearing Examiner pursuant to the provision of Winslow Ordinance 78 - 26 , amending Ordinance 77-24. Section 205 of the Uniform Building (1976 Edition) is deemed amended to read as follows: It shall be unlawful for any person, firm, or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish, equip, use, occupy or maintain any building or structure in the City, or cause or permit the same to be done, contrary to or in violation of any of the provisions of this Code. Any person, firm, or corporation violating any of the provisions of this Code shall be deemed guilty of a misdemeanor, and each such person shall be deemed guilty of a separate offonce for each and every day or portion thereof during which any violation of any of the provisions of this Code is committed, continued, or permitted, and upon conviction of any such v~olation such person shall be punished by a fine of not more than $500 or by imprisonment for not more than six months, or by both such fine and imprisonment. In addition to the above penalties, the City may in its discretion commence a civil action to compel compliance with the provisions of this code in either the Winslow Municipal Court or in Kitsap County Superior Court. Section 303(b) of the Uniform Building (1976 Edition) is deemed amended to read as follows: Plancheck-Checking Fees. When the valuation of the proposed construction exceeds $1,000 and a plan is required to be submitted by subsection (c) of Section 301, a plan checking fee shall be paid to the Building Official at the time of submitting plans and specifications for checking which fee shall be sixty-five percent of the building permit fee as set forth in table 3-A. Section 303(d) of the Uniform Building (1976 Edition) is deemed amended to read as follows: Reinspection Fee. The fee for each reinspection shall be $25.00 except for Group (R)-Division III and (M) occupancies which shall be $15.00. Reinspection fees shall be paid before any further inspections or work is done. Section 403 of the Uniform Building (1976 deemed amended to read as follows: "Building Official", shall mean the City his duly authorized representative. Section 404 of the Uniform Building (1976 deemed amended to read as follows: "City" shall mean the City of Winslow. SECTION 4. AMENDMENTS TO UNIFORM PLUMBING CODE: The Schedule of Fees as stated in Part One Section 4.1, of the Uniform Plumbing Code shall as follows: SCHEDULE OF FEES For issuing each permit IN ADDITION: For each plumbing fixture or trap (including water drainage piping and backflow protection therefore) For each house sewer For each water heater and/or vent For each industrial waste pretreatment intercepter including its trap and vent, excepting kitchen type grease interceptors functioning as fixture traps For each installation, alteration of drainage or vent piping For each installation, alteration or repair of water piping and/or water treating equipment For each lawn sprinkler system on any one meter, including backflow protection devices therefor For vacuum breakers or backflow protective devices on tanks, vats, etc., or for installation on unprotected plumbing fixture, including necessary water piping - one (1) to five (5) For each in excess of five (5) For each swimming pool: Private Public Other fee schedules shall remain as called out in Building Code and Uniform Mechanical Code. SEVERABILITY: If any section, subsection, sentence, clause or phrase of the City of Winslow Building Code or its application to any person or circumstance is held invalid, the remainder of this code, or the application to other persons or circumstances, is not affected. SECTION 7. EFFECTIVE DATE: This Ordinance shall take effect five (5) days after its publication or posting in the manner provided by law.
