ORDINANCE 79 - 10
AN ORDINANCE OF THE CITY OF WINSLOW, WASHINGTON, RELATING
TO THE SALE AND DELIVERY OF KEGS AND OTHER CONTAINERS OF
MALT BEVERAGES IN EXCESS OF SEVEN (7) GALLONS AND REQUIRING
RECORD KEEPING BY THE SELLERS THEREOF
WHEREAS, The City Council of the City of Winslow finds that
the health, safety and we]fare of the citizens of Winslow
require that the sale of kegs and other containers of malt
beverages requires regulation in order to prevent the contents
thereof from being distributed to minors who, pursuant to State
Law, may not consume such alcoholic beverages, now therefore:
The City Council of the City of Winslow DO ORDAIN as
follows:
SECTION I
All natural persons, corporations, and other entities of
any type who sell or offer for sale kegs or other containers
containing seven (7) gallons or more of malt beverage within
the City of Winslow shall require all persons who purchase from
such sellers identification of such persons, including a
Wash].ngton Drivers License, drivers license from some other
state, or equivilant positive identification.
SECTION II
All natural persons, corporations and any other entities of
any type who sell or offer for sale kegs or other containers
containing seven (7) gallons or more of malt beverages within
the City of Winslow shall require all purchasers from such
sellers to sign an affidavit to the effect that such purchaser
will not allow any person under the age of twenty-one (21)
years of age to consume the beverage contained therein.
SECTION III
All natural persons, corporations and any other entities of
any type who sell or offer for sale kegs or other containers
containing seven (7) gallons or more of malt beverage within
the City of Winslow shall record the identification number of
all kegs or other such containers sold to purchasers, and shsll
record the name of the purchaser(s) thereof. Such records
shall be maintained by sellers subject to the inspection of the
police of the City of Winslow for a period of one (!) year.

SECTION IV
No person who purchases a keg or other container containing
seven (7) gallons or more of malt beverage shall al].ow any
person or persons under the age of twenty-one (21) years of age
to consume the content thereof.
SECTION V
Any person, corporation or other entity that shall violate
or shall fail to comply with any provision of this ordinance
shall be guilty of a misdemeanor and shall be punishable by a
fine not in excess of five hundred ($500.00) dollars or
imprisonment for a term not to exceed six (6) months, or both
such fine and imprisonment. Any person, corporation or other
entity that shall violate or shall fail to comply with any
provision of this ordinance may also be enjoined, in a civil
suit in the Municipal Court of the City of Winslow or the
Superior Court of Kitsap County, at the option of the city,
from such violation or failure to comply. The City of Winslow
may also report violations or instances of failure to comply to
the Washington State Liquor Control Board.
