AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WINSLOW,
WASHINGTON, ORDERING THE IMPROVEMENT OF A PORTION OF THE
CITY BY THE CONSTRUCTION AND INSTALLATION OF STREET
IMPROVEMENTS CONSISTING OF BOTH CONSTRUCTING NEW STREETS
AND WIDENING AND RESURFACING EXISTING STREETS, INSTALLATION
OF SANITARY SEWERS, STORM SEWERS AND APPURTENANCES, CURBS,
GUTTERS, GRAVEL WALKS AND REQUIRED WATER MAIN RELOCATIONS
IN ACCORDANCE WITH RESOLUTION NO. 79-02 OF THE CITY COUNCIL
OF THE CITY OF WINSLOW, WASHINGTON; ESTABLISHING LOCAL
IMPROVEMENT DISTRICT NO. 6; PROVIDING THAT PAYMENT FOR THE
IMPROVEMENT BE MADE BY SPECIAL ASSESSMENTS UPON PROPERTIES
IN THE DISTRICT, PAYABLE BY THE MODE OF "PAYMENT OF BONDS";
AND PROVIDING FOR THE ISSUANCE AND SALE OF LOCAL
IMPROVEMENT DISTRICT WARRANTS REDEEMABLE IN CASH AND LOCAL
IMPROVEMENT DISTRICT BONDS.
WHEREAS, by Resolution No. 79-02 adopted ~July 2, ]979, the
City Council of the City of Winslow, Washington, declared its
intention to improve a port]on ef the City by the construction
and ]~sta]]ation of a municipal street improvement district to
assess the cost and expense of carrying out such improvement
against the properties specia!]y benef~ted thereby and fixed
the 6th day of August, ]979, at 7:30 o'clock p.m. (PDT), at the'
City Hall, State Highway 305 and Winslow Way East, Winslow,
Washington, as the time and place of hearing al]~ matters
relating tc the proposed ~mprovement and all objections thereto
and for determining the method of payment for that improvement;
and
WHEREAS, the City of Winslow Engineering Off]~ce caused an
estimate to be made of the costs and expenses of the propose~
improvement and certified that estimate to the City Council,
together with all papers and information in their possession
relating to the proposed improvement, a description of the
boundaries of the D]str~ct, a statement of what portion of the
cost and expense of the imprcvement should be borne by the
properties within the proposed District, and a statement of the
aggregate actual valuation of the real estate, including twenty
five percent (25%) of the actual valuation of the improvements
]n the proposed District, according to the valuation last
placed upon ]t fcr the purpose of general taxation; an~
WHEREAS, that estimate ]s accompanied by a diagram of the
proposed improvement showing thereoD the lots, tracts, parcels
of ].ands and other property which will be specially benefited
by the proposed improvement, and the estimated amount of the
cost and expense thereof to be borne by each lot, tract and
parcel of land or other property; and
WHEREAS, due notice of the hearing upon Resolution No.
79-02 was given in the manner required by law; and
objections to the proposed improvements presented to the City
Council on or before that date were duly considered by the City
Council amd overruled and a]] persons appearing at the hearing
were heard; and
WHEREAS, the City Council deems it necessary and in the
best interests of the City that the improvement as hereinafter
described be carried out and that a local improvement district
be created in connection therewith; NOW, THEREFORE,
The City Council of the City of Winslow, Washington DO
ORDAIN as follows:
Section 1. It is hereby ordered that the portion of the
City described in Exhibit "A" attached hereto and by this
reference made a part hereof be improved by constructing and
installing a municipal street improvement, consisting of both
constructing new streets and widening and resurfacing existing
streets, insta].lation of sanitary sewers, storm sewers and
appurtenances, curbs, gutters, gravel walks and required water
main relocat]ons, being one continuous unit of improvement, all
as more specifically described in Exhibit "B" attached hereto
and by this reference made a part hereof.
All of the foregoing shall be in accordance with the plans
and specifications therefor prepareA by the City of Winslow
Engineering Office.
The City of Winslow may modify the details of the foregoing
improvement provide~ such modifications are deemed necessary or
advisable in the judgment of the City Council and will not
substantially change the purpose for which such ~mprovement is
to be made.
Section 2. There is hereby created and established a local
improvement district to be known ann designated as "Local

Improvement District No. 6 of the City of Winslow, Washington",
the boundaries thereof being more particularly described in
Exhibit "A" attached hereto and by th~s reference incorporated
herein.
Section 3. The total estimated standard construct]on cost
of such improvement is hereby declared to be One Hundred and
Seventy Thousands Dollars ($]70,000.00), and the entire cost
and expeDse of such improvement shall be borne by and assessed
against the properties specially benefited by such improvement
included in the local improvement district herein established
embracing as near as may be all properties specially benefited
by such improvement.
Section 4. In accordance with the provisions of RCW
35.44.047, the City may use any method or combination of
methods to compute assessments which may be deemed to fairly
reflect the spec]a~ benefits to the properties being assessed.
Section 5. Local ].mprovement district warrants shall be
issued in payment of the cost and expense of the improvement,
such warrants to be payable out of the "Local Improvement Fund,
District No. 6, hereinafter created, to bear interest from the
date thereof at a rate to be hereafter fixed by ordinance not
exceeding the maximum rate permitted by law and to be redeemed
in cash, and/or by local improvement district bonds herein
authorized to be issued, the interest bearing warrants to be
hereafter referred to as "revenue warrants". The bonds shall
bear interest at a rate to be hereafter fixed by ordinance not
exceeding the max]mum rate permitted by law, shall be payable
on or before twenty-two (22) years from the date of issuance,
the life of the improvement ordered being not less than
twenty-two (22) years, and shal~ be issued in exchange for and
in redemption of any and all revenue warrants issued hereunder
and not redeemed in cash within a period not to exceed 60 days
after the first publicat]on by the City Treasurer of notice
that the assessment roll for "Local_ Improvement District No. 6
is in her hands for collection. The bonds shall be redeemed by
the collect]on of special assessments to be levied and assessed
upon the property

within the District, payable in twenty (20) equal annual
installments with interest at a rate to be hereafter fixed by
ordinance not exceeding the maximum rate permitted by law,
under the mode of "payment by bonds", as defined by law and the
ordinances of the City of Winslow. In the case of default in
the payment of any assessment when the same shall become due,
there shall be added interest at a rate to be hereafter fixed
by ordinance not to exceed the max]mum rate permitted by law
and a penalty of nine percent 19%) shall also be collected.
The exact form, amount, date, interest rate and denominations
of the warrants and bonds sha!] be hereafter fixed by ordinance
of the City Council. The warrants and bonds shall be sold in
the manner the City Council shall hereafter determine.
Section 6. All work necessary to be done in connection
with the making of that improvement shall be done by and made
by contract upon competitive bids and the City shall have and
reserves the right to reject any and all bids. All contracts
authorized pursuant to this ordinance shall include a statement
that payment for such work will be made in cash warrants drawn
upon the "Local Improvement Fund, District No. 6"
Section 7. There is hereby created and established in the
office of the City Treasurer of the City of Wins]~ow, for "Local
Improvement Fund, District No. 6", into which fund shall be
deposited the proceeds from the sale of revenue warrants ~rawn
against that fund which may be issue~ and sold by the City and
collections pertaining to assessments and against which fund
shall be issued cash warrants to the contractor or contractors
in payment for the work to be done by them in connection with
the improvement, and against which fund cash warrants shall be
issued in payment of all other items of expense in connection
with the improvement.
Section 8. This ordinance shall become effective five (5)
days after publication or posting in the manner provided by law.

PASSED by the City Council and approved by the Mayor of the
City of Winslow, Washington, at a regular open public meeting
thereof, this 20th day of August, 1979.
