AN ORDINANCE OF THE CITY OF WINSLOW ';~THO NG -
DUJARDIN CUSTOM HOMES, INC., TO DEVELOP PROPERTY
COMMONLY KNOWN AS "WINSLOW ARMS" AS A PLANNED UNIT
DEVELOPMENT PURSUANT TO ORDINANCE NO. 69 - ]6, AND
AMENDING THE COMPREHENSIVE PLAN AND ZONING MAP OF THE
CITY OF WINSLOW AS IT APPLIES TO THAT PROPERTY
WHEREAS, Dujardin Custom Homes, Inc., (hereinafter "the
Developer") has file~ with the City of Winslow an appl]catioD
for a proposed planned unit development pursuant to Ordinance
69-16, and
WHEREAS, the Winslow Hearing Examiner held a public hearing
OD tb]s application on February 26, ]979, and after entering
Findings of Fact and Conclusions of Law recommended that the
City COUDC]I approve the propose~ planned unit development
subject to conditions, and
WHEREAS on SeDt. 17 , ]979, the Winslow City Council
fully considered the amended application of Dujardin Custom
Homes, Inc., the Findings of Fact, Conclusions of Law and
Recommendat]on of the Hearing Examiner, and the materials
subm~tte~ for review with respect to Winslow Arms and voted to
approve the Winslow Arms planned unit development (hereinafter
"the PUD") subject to conditions;
NOW, THEREFORE, The City Council of the City of Winslo~ DO
ORDAIN as follows:
]. Subject to the conditions set forth in Paragraph ~ below,
the PUD, as described in the documents ]iste~ in
Subparagraphs ~.a. through 1.c. immediately below, is
approved.
a. Application for ~pprov~l of t~e Winslow Arms property
as a planbed unit development flied w]tb the City of
Winslow on April 12, 1978.
b. Site P]am entitled Proposed 60 UDit Apartment for the
elderly prepared by Vigil and Bradbury, Architects on
file with the Winslow City Clerk.

c. Legal description of Winslow Arms OD file with the
City Engineer.
2. Approval of the PUD ]s subject to the following CoDd]t]OnS:
a. Conformity to Proposal - Development of the PUD shall
conform to the description contained ]n Paragraph ]
above.
b. Easements for Walking Path Access - The developer
shall make good-faith efforts to obtain easements for
a walking path access from the PUD to Madison Avenue
North.
c. Water Supply - No occupancy shall be permitted in the
PUD until, in the Opin]oD of the City Engineer, the
City has acquired additional water sources sufficient
to serve the project.
Water Hydrant and Main - The developer shall ~nstal]
on the PUD site a three-way water hydraDt served by a
six inch water ma~n.
e. Dro]nage - The developer shat~ install a storm water
drainage system, including surface oil separators,
which system shall be approved by the City Engineer.
f. Connection to Winslow Trail System - The ~eve]oper
shall build across the PUD property a pathway which
will allow public access across the property and which
will tie into the Winslow Trail System.
g. Easements to Finch Place - The developer will prepare
at h~s own expense, and file with the City, a letter
of intent guaranteeing that he will participate with
the City ]n acquiring easements to Finch Place.
h. Financing
]. Construct]on will not start unt]! the City of
Winslow has written evidence of subsidized loan
obligation and an interim f~nancing letter for the PUD
operation.

Winslow of the PUD approval contained in this
ordinance untiJ compliance occurs.
1. Other Permits - Approval of this PUD as contained
herein does not authorize construct]on, grading,
preliminary preparation of the property or any other
development. Prior to undertaking any activity on the
PUD property, the developer must obtain such permits
as are required by law.
m. Litigation - In the event any litigation occurs for
the purpose of interpreting the requirements,
conditions and restrictions contained in this
ordinance, the prevailing party shall be entitled to
costs, including a reasonable attorney's fee.
3. The comprehensive plan and zoning map of the City of
Winslow be and hereby are deemed amended to refJ. ect that
Winslow Arms, the legal description of which is on file
with the City Engineer, is designated a planned unit
development and is to be developed in conformity with the
provisions of this ordinance.
This ordinance shall become effective five (5) days after
posting as required by law.
PASSED by the City Council of Winslow, Washington,
this 17th day of Sentember , ]979.
