ORDINANCE NO. 2021-36
AN ORDINANCE of the City of Bainbridge Island, Washington,
amending Chapter 3.84 of the Bainbridge Island Municipal Code
(“BIMC”) to update the list of authorized check signers and to
update the authorized forms of payment; and to ratify the
designation of Umpqua Bank as the City’s designated public
depository.
WHEREAS, RCW 35A.40.020 requires that the City Council designate the City’s public
depository; and
WHEREAS, Chapter 3.84 BIMC requires the Council approve of the designation of the City’s
public depository; and
WHEREAS, Ordinance No. 2010-28, codified as Chapter 3.84 BIMC, updated the list of
authorized City check signers; and
WHEREAS, due to changes in job titles and the elimination of others there is a need to further
update the list of authorized City check signers contained in Chapter 3.84 BIMC; and
WHEREAS, it has come to City staff’s attention that although there are bank resolutions
authorizing the Municipal Court Judge and the Court Administrator to sign Municipal Court
bank account checks, the job titles are not listed in Chapter 3.84 BIMC as authorized signers; and
WHEREAS, Chapter 3.84 BIMC currently lists checks and warrants as the only authorized
forms of payment; and
WHEREAS, in addition to using checks, the City currently makes payments by bank wire,
automated clearing house (ACH) transaction, credit card, and other electronic forms.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND,
WASHINGTON, DOES ORDAIN AS FOLLOWS:
Section 1. Chapter 3.84 of the Bainbridge Island Municipal Code, is hereby amended to
read as follows:

CITY PAYMENTBY CHECK OF CITY OBLIGATIONS
3.84.010 Procedures.
All claims or other obligations of the city which are payable out of solvent funds
shall be paid by: the issuance of a bank check or warrant, bank wire, automated

clearing house (ACH) transaction, credit card, or other electronic means;
provided, that no check or other forms of payment shall be issued when the
applicable fund is not solvent at the time payment is ordered., but a warrant shall
be issued instead. The public depository upon which such checks are to be drawn
shall be that banking institution under contract with the city and approved by the
city council. Two signatures of the following officers of the city shall validate a
check: city manager, finance director, accounting manager, budget manager, cost
accountant and senior accountant.
Section 2. A new Section 3.84.020 of the Bainbridge Island Municipal Code is hereby
added as follows:
3.84.020 Two city officer signatures required for city checks.
Two signatures of the following officers of the city shall validate a check: city manager,
deputy city manager, finance director, accounting manager, budget manager, and senior
financial analyst cost accountant and senior accountant. In addition to the signers listed
above, the city’s municipal court bank account checks may also be signed by the
municipal court judge and court administrator.
Section 3. The City Council, by and through the passage of this ordinance, ratifies the
designation of Umpqua Bank as the City’s public depository to be used for payment of city
obligations.
Section 4. This ordinance shall take effect and be in force five (5) days from its passage
and publication as required by law.
