Resolution No. 2022-03 Setting a Public Hearing Date for Surplus Property to WSDOT for SR305 Roundabout - Approved 022222Page 1 of 2 RESOLUTION NO. 2022-03 A RESOLUTION of the City Council of Bainbridge Island, Washington, relating to fixing a date for a public hearing to consider transferring surplus property from the City of Bainbridge Island to the Washington State Department of Transportation (WSDOT) in support of their proposed SR 305 Roundabout Project. WHEREAS, the City has received a request from the Washington State Department of Transportation (WSDOT) to acquire real property to support its SR 305 Roundabout Project; and WHEREAS, the proposed real property identified as Tax Parcel Number 332602-2-062- 2006 is a triangle-shaped property located at the intersection of SR305 and NE Seabold Road (See: attached Exhibit A – “location map”); and WHEREAS, the subject tax parcel (Auditor’s File No. 201711070031) was originally deeded to the City of Bainbridge Island in 2017 at no cost to the City, and now WSDOT wishes to reacquire the parcel for its SR305 Roundabout project at no cost; and WHEREAS, pursuant to RCW 39.33.010, the city may purchase and/or transfer surplus property to other governmental agencies without regard to bid laws; and WHEREAS, any tangible personal property owned by the City that is no longer needed presently or in the foreseeable future may be disposed of as surplus; and WHEREAS, Tax Parcel No. 332602-2-062-2006 is surplus to the city’s needs and has no beneficial public use by the city. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND DOES RESOLVE AS FOLLOWS: Section 1. The City Council shall hold a public hearing as part of the process to consider whether to declare real property surplus to the needs of the City. Section 2. Notice of the public hearing shall be given and a news release shall be disseminated in accordance with the terms of RCW 39.33.020. Section 3. At least ten days, but not more than twenty-five days, prior to the public hearing, there shall be published public notice setting forth the date, time, and place of the hearing at least once in a newspaper of general circulation and where the property is located. Section 4. The date and time of March 22, 2022, at 6:00 PM, or as soon thereafter as the matter may be heard, is hereby established as the date on which the Page 2 of 2 Bainbridge Island City Council will hold a public hearing to consider a proposed Surplus Resolution to transfer from the City to WSDOT for the benefit of WSDOT’s future SR305 Roundabout project. The hearing will be held as part of the regular City Council meeting at Bainbridge Island City Hall, in the Council Chambers, located at 280 Madison Avenue North, Bainbridge Island, Washington. Section 5. Severability. If any one or more sections, subsections, or sentences of this Resolution are held to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portion of this Resolution and the same shall remain in full force and effect. Section 6. This Resolution shall take effect and be in force immediately upon its passage. PASSED by the City Council this 22nd day of February, 2022.
