Resolution No. 2022-27 Providing for No Annual CPI Adjustment for Certain Fees in 2023 - Approved 102522Page 1 of 3 RESOLUTION NO. 2022-27 A RESOLUTION of the City of Bainbridge Island, Washington, relating to certain Building and Planning, Public Records, and Water and Sewer System Participation fees and providing for no automatic Consumer Price Index annual adjustment in 2023 for these fees. WHEREAS, RCW 82.02.020 authorizes the collection of reasonable fees to cover the costs to the City for certain activities; and WHEREAS, the City of Bainbridge Island periodically updates the City’s Fee Schedule to reflect City Council actions and the actual cost to the City of various services in accordance with state law; and WHEREAS, the City periodically corrects errors in the Fee Schedule and makes certain changes for clarity; and WHEREAS, on March 22, 2022, the City Council enacted Ordinance No. 2022-05, of which Section 4 allows that all fees or charges levied by the City pursuant to the authority vested in state law, including RCW 82.02.020, shall be subject to an adjustment beginning with the first full billing period of 2023 and each year thereafter equal to the annual percentage increase in the United States Consumer Price Index, Seattle area (“CPI-U”) for June of the preceding year as shown in the release from the Bureau of Labor Statistics, unless the City Council determines by December 31st of any year that the adjustment shall be another amount or shall not occur for the next year; and WHEREAS, also on March 22, 2022, the City Council enacted Resolution No. 2022-06, which authorized updates to the City’s Fee Schedule as determined by the results of a fee study by the FCS Group, and the updated fees included the fees in Section 9, Building and Planning Fees, of the Fee Schedule, and the resolution provided that those fee updates would take effect on September 1, 2022; and WHEREAS, on July 12, 2022, the City Council enacted Resolution No. 2022-22, which provided for corrections and clarifications related to Section 9, Building and Planning Fees, of the Fee Schedule; and WHEREAS,City staff have identified that specific fee increases that are otherwise scheduled to take effect on January 1, 2023 are not warranted for certain fees based on the unique nature of those fees or due to recent fee increases related to some of those fees;and WHEREAS, pursuant to Section 4 of Ordinance No. 2022-05, the City Council has the authority to determine by December 31, 2022 that the automatic fee adjustment that is scheduled to take effect on January 1, 2023 shall not occur for 2023 for fees so identified by the Council; and Page 2 of 3 WHEREAS, an automatic fee adjustment related to Section 9, Building and Planning Fees, of the Fee Schedule is not warranted for 2023 because those fees were increased recently on September 1, 2022; and WHEREAS, an automatic fee adjustment is also not warranted related to Section 3.A., Public Records Fees, of the Fee Schedule because those fees are based on flat fees for paper and electronic copies of public records as allowed by WAC 44-14-070, and those fees are therefore not subject to fee increases based on other calculation methods; and WHEREAS, an automatic fee adjustment is also not warranted related to Sections 11.A.I.A. (System Participation Fees, Water) and 11.A.I.B. (System Participation Fees, Sewer) of the Fee Schedule because RCW 35.92.025 authorizes the collection of fees for connecting to water or sewerage systems,referred to as a “system participation fee,” based on an equitable share of the cost of the system; and WHEREAS, the City computes water and sewer system participation fees based on a methodology that uses the historical cost of existing assets plus an additional component for future water and sewer projects included in the Capital Improvement Plan; and WHEREAS, the Consumer Price Index (“CPI”) is a measure of the average change over time in the prices paid by urban consumers for a basket of consumer goods and services and, therefore, the CPI methodology is an inappropriate measure of costs associated with constructing utility infrastructure and, in particular, related to system participation fees. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DOES ORDAIN AS FOLLOWS: Section 1.Pursuant to Section 4 of Ordinance No. 2022-05, the City Council hereby determines that due to the recent increase set forth in Section 9, Building and Planning Fees, of the Fee Schedule that was effective on September 1, 2022, no automatic Consumer Price Index (“CPI”) adjustment shall occur for those Building and Planning Fees for 2023. Section 2.Pursuant to Section 4 of Ordinance No. 2022-05, the City Council hereby determines that due to the unique nature of the fees set forth in Section 3.A., Public Records Fees, of the Fee Schedule, which fees are otherwise set based on state law and WAC 44-14-070, no automatic CPI adjustment shall occur for those Public Records Fees for 2023. Section 3.Pursuant to Section 4 of Ordinance No. 2022-05, the City Council hereby determines that due to the unique nature of the fees set forth in Sections 11.A.I.A. (System Participation Fees, Water) and 11.A.I.B. (System Participation Fees, Sewer) of the Fee Schedule, which fees are otherwise set based on an equitable share of the cost of the water or sewer system, no automatic CPI adjustment shall occur for those Water and Sewer System Participation Fees for 2023. Page 3 of 3 Section 4.Exhibit A, which is hereby adopted and incorporated fully into this resolution, sets forth the fees described in Sections 1-3 above for which no automatic annual CPI adjustment shall occur for 2023. Section 5.Severability. If any one or more sections, subsections, or sentences of this resolution are held to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portion of this resolution and the same shall remain in full force and effect.
