Ordinance No. 2023-14 Amendments to 2.14.020 Planning Commission Mtg Time (Approlved 032823) Page 1 of 3 ORDINANCE NO. 2023-14 AN ORDINANCE of the City of Bainbridge Island, Washington, amending 2.14.020 of the Bainbridge Island Municipal Code related to Planning Commission meeting time. WHEREAS, existing BIMC 2.14.020.E specifies that regular Planning Commission meetings begin at 7:00 PM, requiring that any other meeting that begins earlier to be identified as a “special meeting”; and WHEREAS, recently, most Planning Commission meetings have begun at 6:00 PM and identified as “special meetings”; and WHEREAS, this amendment to BIMC 2.14.020.E related to Planning Commission meeting start time was originally included in Ordinance No. 2023-04 together with amendments to BIMC 2.16.210 related to subarea planning; and WHEREAS, the Planning Commission considered draft Ordinance No. 2023-04 on January 26, 2023, and did not amend the ordinance related to the proposed amendment to Planning Commission meeting time; and WHEREAS, the Planning Commission held a public hearing on Ordinance No. 2023-04 on March 16, 2023, and after closing the public hearing, continued discussion of the subarea planning process, ultimately making a recommendation of approval of Ordinance No. 2023-04 to the City Council, without any additional amendments to the Planning Commission meeting time section; and WHEREAS, subsequent legal review recommended separating the unrelated topics of subarea planning and Planning Commission meeting time into 2 separate ordinances; and WHEREAS, the amendment to BIMC 2.14.020.E related to Planning Commission meeting time was removed from Ordinance No. 2023-04 and reviewed by the City Council in Ordinance No. 2023-14; and WHEREAS, on March 28, 2023, the City Council considered Ordinance No. 2023-14 and adopted Ordinance No. 2023-14. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DOES ORDAIN AS FOLLOWS: Section 1. Section 2.14.020.E. of the Bainbridge Island Municipal Code is hereby amended to read as follows: Page 2 of 3 E. Meetings. 1. The planning commission shall meet on the second and fourth Thursday of each month and may hold such special meetings on other days, as the planning commission may determine necessary. All rRegularly scheduled meetings will shall begin at 6:00 p.m. 7:00 p.m. and shall endeavor to adjourn by 9:00 p.m.; provided, that the hours of a regular meeting may be modified for exceptional purposes, as determined by the chairperson in coordination with the director, subject to the requirements of the Open Public Meetings Act. 2. Planning commission meetings shall be held at the city of Bainbridge Island City Hall. Under special circumstances, regular and special meetings and retreats may be held in other locations as publicly noticed. 3. The planning commission shall give public notice of its meetings as provided by law. Notice for a public hearing shall be provided at least 10 days in advance of said hearing. 4. All meetings of the planning commission shall be open to the public and held in accordance with the Open Public Meetings Act (Chapter 42.30 RCW). In the event a regular meeting falls upon a legal holiday, the meeting shall be held on the following business day. 5. All meetings shall be conducted according to Robert’s Rules of Order. 6. The planning commission shall review and approve rules of procedure and code of conduct annually. Section 2. Severability. Should any section, paragraph, sentence, clause, or phrase of this ordinance, or its application to any person or circumstance, be declared unconstitutional or otherwise invalid for any reason, or should any portion of this ordinance be preempted by state or federal law or regulation, such decision or preemption shall not affect the validity of the remaining portions of this ordinance or its application to other persons or circumstances. Section 3. This ordinance shall take effect and be in force five (5) days from its passage and publication as required law. PASSED by the City Council this 28th day of March, 2023.
