ORD 2005-21 MULTI-FAMILY HOUSING
ORDINANCE 2005-21
An Ordinance of the City of Bainbridge Island,
pertaining to multifamily housing, and amending
Chapter 18.21, Chapter 18.24 and Chapter 18.27 of
the Bainbridge Island Municipal Code.
WHEREAS, the City adopted a Comprehensive Plan on September 1, 1994,
subsequently amended, which contains a Housing Element that establishes goals and
policies to encourage the availability of diverse housing options to all economic
segments, promote a variety of densities and housing types, and encourage preservation
of existing housing stock; and
WHEREAS, the City's Housing Element also includes goals and policies that
speak to increasing the supply of multifamily housing in the City, and
WHEREAS, multifamily housing is allowed with a conditional use permit in all
of the City's residential zones, except for the R-4.3, R-3.5 and R-2.9 zones; and
WHEREAS, in September 2003 the Mayor appointed the Ninety-Day Affordable
Housing Task Force, charged with reviewing the City's housing programs; and
WHEREAS, the Task Force recommended a number of revisions to the City's
housing programs, including allowing multifamily housing with a conditional use permit
in the R-4.3, R-3.5 and R-2.9 residential zones; now therefore,
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON
DO ORDAIN, AS FOLLOWS:
Section 1. Section 18.21.010 of Chapter 18.21 of the Bainbridge Island
Municipal Code is amended as follows:
18.21.010 Purpose.
The purpose of the R-4.3 zone is to provide for vital single family residential
neighborhood~ having urban density and having those community improvements and
facilities normally associated with urban area development.
Section 2. Section 18.21.030 of Chapter 18.21 of the Bainbridge Island
Municipal Code is amended as follows:
18.21.030 Conditional uses.
Conditional uses are:
A. Agriculture;
B. Child day care centers;

C. Educational, cultural, governmental, religious or health care facilities;
D. Major home occupations;
E. Multifamilv dwellings;
~ F. Public and private utility buildings and structures;
~ G. Public parks and playgrounds;
G:- H. Shared-use park and ride lots.
Section 3. Section 18.24.010 of Chapter 18.24 of the Bainbridge Island
Municipal Code is amended as follows:
18.24.010 Purpose.
The purpose of the R-3.5 zone is to provide for vital single family residential
neighborhoods having those community improvements and facilities normally associated
with suburban development.
Section 4. Section 18.24.030 of Chapter 18.24 of the Bainbridge Island
Municipal Code is amended as follows:
18.24.030 Conditional uses.
Conditional uses are:
A. Agriculture;
B. Bed and breakfast establishments;
C. Child day care centers;
D. Educational, cultural, governmental, religious or health care facilities;
E. Major home occupations;
F. Multifamilv dwellings;
~ G. Public and private utility buildings and structures;
G..H. Public parks and playgrounds;
fh 1. Shared-use park and ride lots.
Section 5 Section 18.27.010 of Chapter 18.27 of the Bainbridge Island
Municipal Code is amended as follows:
18.27.010 Purpose.
The purpose of the R-2.9 zone is to provide for vital single family residential
neighborhoods in a suburban residential area not requiring a full range of urban
community improvements and facilities.
Section 6. Section 18.27.030 of Chapter 18.27 of the Bainbridge Island
Municipal Code is amended as follows:
18.27.030 Conditional uses.
Conditional uses: are:
A. Agriculture and accessory uses except agricultural processing;
B. Bed and breakfast establishments;
C. Child day care centers;

D. Educational, cultural, governmental, religious or health care facilities;
E. Major home occupations;
F. Multifamilv dwellings;
~ G. Public and private utility buildings and structures;
G.B. Public parks and playgrounds;
H:- L Shared-use park and ride lots.
Sectiolll 8. This ordinance shall take effect five days after its passage, approval
and publication as required by law.
