ORDINANCE NO. 2006-03
AN ORDINANCE of the City of Bainbridge
Island, Washington, amending the Official Zoning
Map, changing the zoning designation of a 0.8 acre
parcel at 187 Ericksen Avenue N. (Tax parcel
262502-3-047-2004) from Mixed Use Town
Center/Ericksen Overlay District to Mixed Use
Town Center/Core Overlay District.
WHEREAS, on September 1, 1994, the City adopted a Comprehensive Plan and a
Comprehensive Plan Land Use Map, subsequently amended; and
WHEREAS, on February 20, 1992, by official action of the City Council through
adoption of Ordinance 92-08, the official zoning map of the City of Bainbridge Island was
adopted along with Title 18 of the Bainbridge Island Municipal Code; and
WHEREAS, Dr. Haggar and Dr. Scribner submitted a Comprehensive Plan Amendment
application on June 24, 2004 to change the land use designation of their propeliy, a 0.8 acre
parcel located at 187 Ericksen Avenue N (Tax parcel 262502-3-047-2004), from Mixed Use
Town Center/Ericksen Overlay District to Mixed Use Town Center/Core Overlay District; and
WHEREAS, in accordance with the process specified in Bainbridge Island Municipal
Code Chapter 18.117 Comprehensive Plan Anwndment Procedures, the City reviewed the land
use designation for tax parcel 262502-3-047-2004; and
WHEREAS, on November 22, 2005; the City Council passed Ordinance 2005-06,
amending the Land Use Map of the Comprehensive Plan to change to the land use designation
for tax parcel 262502-3-047-2004 from Mixed Use Town Center/Ericksen Overlay District to
Mixed Use Town Center/Core Overlay District; and
WHEREAS, the Comprehensive Plan Land Use Map and the Official Zoning Map must
be consistent under the Growth Management Act; and
WHEREAS, the zoning designation of the subject property, tax parcel no. 262502-3-
047-2004, must be changed from Mixed Use Town Center/Ericksen Overlay District to Mixed
Use Town Center/Core Overlay District in order to correspond with the Comprehensive Plan
Official Land Use Map; and

WHEREAS, the City has initiated the rezone of the subject property, in accordance with
the process outlined in Chapter 2.18 of the Bainbridge Island Municipal Code. On February 9,
2006 the Planning Commission held a public hearing on the rezone of the subject property and
voted to recommend approval in forwarding on this Ordinance to the City Council for review;
now therefore:
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND,
WASHINGTON, DO ORDAIN, as follows:
Section 1. The City of Bainbridge Island Official Zoning Map is amended, changing the
zoning designation for tax parcel 262502-3-047-2004 from Mixed Use Town Center/Ericksen
Avenue Overlay District to Mixed Use Town Center/Central Core Overlay District, as shown in
the attached map, Exhibit A.
Section 2. The City Clerk is authorized and directed to file this ordinance with the Kitsap
county Auditor, and to file one copy with the recording number with the Kitsap County Assessor
and the property owner.
Section 3. This ordinance shall take effect five days after its passage, approval, and
publication as required by law.
