ORD 2006-06 APPROVAL PROCESS FOR WATER & SEWER SERVICE AVAILABILITY ORDINANCE 2006-06 AN ORDINANCE of the City of Bainbridge Island, Washington, defining new terms used in the approval process for water and sewer availability; and adding new sections 13.04.005, 13.04.007,13.04.173,13.04.175, and 13.04.177 to Chapter 13.04 of the Bainbridge Island Municipal Code. WHEREAS, the City has developed a more consistent and efficient process for reviewing and approving water and sewer service availability requests, and WHEREAS, the City desires to establish a process that provides for a limited reservation and unlimited reservation of water and sewer system capacity; and WHEREAS, the City has detennined that new terms associated with a revised process for revie\ving and approving water and sewer service availability need to be defined, and WHEREAS, the City has determined that improving the management of flow through City water meters is in the City's best interest; now, therefore THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. A new Section 13.04.005 is added to the Bainbridge Island Municipal Code to read as follows: ""13.04.005 Binding commitment for a limited reservation of water or sewer system capacity A . hi ndi ng commitment for a limited reservation 0 r \vater or sewcr system capacity' means that upon the payment of a system participation fee deposit pursuant to BIMC 13.16.040, the city shall reserve \'vater or sewer system capacity, and shall allO\v connection to the city's \vater or sewer system. for a period not to exceed four (4) years from the issuance dZlte of an approved binding commitment letter." Page 1 on Section 2. A new Section 13.04.007 is added to the Bainbridge Island Municipal Code to read as tollows: ""13.04.007 Binding commitment for an unlimited .-eservation of water or sewer system capacity A 'Binding commitment for an unlimited reservation of water or sewer system capacity' means that, upon the payment of all applicable system participation fees and charges set forth in BIMC 13.16.040, the city shall reserve water or sewer system capacity, and shall allow connection to the city's water or sewer system, in peq)etuity. " Section 3. A new Section 13.04.173 is added to the Bainbridge Island Municipal Code to read as follows: ""13.04.173 Maximum rate of intermittent water flow 'Maximum rate of intemlittent water flow' means the maximum rate of flow at which water should be passed through a city water meter for short, intermittent periods as established by the water meter manufacturer's published maximum intermittent flow rate." Section 4. A new Section 13.04.175 is added to the Bainbridge Island Municipal Code to read as follows: ""13.04.175 Maximum rate of continuous water flow 'Maximum rate of continuous water tlow' means the maximum rate of flow at which water should be passed through a city water meter for continuous operation as established by the American Water Works Association or by the meter manufacturer's published maximum continuous flow rate." Section 5. A new Section 13.04.177 is added to the Bainbridge Island Municipal Code to read as follows: ""13.04.177 Non-binding commitment for water or sewer system capacity A 'Non-.binding commitment for water or scwer system capacity' means the city currently has available water or sewer system capacity but does not guarantee the future availability of water or sewer system capacity." Section 6. This ordinance shall take effect and be in force forty five (45) days from and after its passage, approval and publication as provided by law.
