RES 2006-14 OPEN SPACE COMMISSION AUTHORITY (2001-48)RESOLUTION NO, 2006 -14 A RESOLUTION of the City Of Bainbridge Island, Wa, providing new authority to the Open Space Commission WHEREAS, on September 12th 2001, the Bainbridge Island City Council (the City Council) passed Ordinance 2001-36 to submit to city voters an $8,000,000 bond levy to pay the costs of acquiring and preserving open space, and create new trails and passive parks (the "Project"), and Resolution 2001-48 to create an Open space Commission to implement the Project: and WHEREAS, the Open Space Bond levy was approved on November 6, 2001: and WHEREAS, the ballot proposition language required the City of Bainbridge Island (the City) to "consider citizen commission recommendations;" and WHEREAS, the authority granted by Resolution 2001-48 to the citizen's advisory commission (Open Space Commission), is specifically limited to the four purposes in Section 1, directly relating to the Project (spending the $8,000,000); and WHEREAS, the authority provided in Section 1 of Resolution 2001-48 has now expired: and WHEREAS, the City desires to provide new authority to the Open Space Commission to continue doing similar work, with funding as the City Council may approve; now, therefore THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, DOES RESOLVE AS FOLLOWS: Section 1. Open Space Commission continuance and new authority. The citizen's advisory commission (Open Space Commission) created pursuant to Resolution 2001-48, is hereby continued with new authority to pursue the following purposes: 1. Identify and recommend island forest areas, meadows, beaches, wildlife habitat, critical areas, farms, and agricultural lands to the City Council for City purchase; for the purpose of open space acquisition, preservation, and/or possible development of new trails and amenities; supported by City council approved funding. 2. Upon request: of the City Council, offer recommendation for the sale or transfer of rights for identified City properties, in pursuit of Paragraph 1. Section 2. Open Space Commission membership and terms. The commission shall continue with the current membership and terms, as provided in Resolution 2001-48, Section 2.
