A RESOLUTION of the City of Bainbridge Island,
Washington, expressing support for the formation of a
Bainbridge Island Metropolitan Park & Recreation District.
WHEREAS, the Board of Commissioners of the Bainbridge Island Park & Recreation District (the
"Park District") has determined by resolution that the formation of a metropolitan park district under Chapter
35.61 RCW will provide the most efficient and effective provision for public park and recreation facilities
and programs, and the most stable funding base to continue operations for such facilities and programs; and
WHEREAS, through adoption of Resolution 2004-3, the Board of Commissioners of the Bainbridge
Islland Park & Recreation District has authorized placement. of the metropolitan park district measure on the
ballot for the September 14, 2004 election upon approval by voter petition; and
WHEREAS, the Kitsap County Auditor has issued a Certificate of Sufficiency verifying that the
petition to form a metropolitan park district has been signed by the required fifteen percent of registered
voters necessary to place the measure on the ballot; and
WHEREAS, the Park District will provide for the cost of such election; and
WHEREAS, the City Council has determined that the best interests of the public will be served by
the formation of a metropolitan park district as a governmental entity separate and distinct from the City,
with boundaries coextensive with the boundaries of the City and governed by a board of five park
commissioners newly elected pursuant to RCW 35.61.050(2); now, therefore
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON DOES
RESOLVE as follows:
Section 1. Declaration of Intent. The City Council hereby supports in principle the proposition of
creating a metropolitan park district pursuant to Chapter 35.61 RCW to be known as the "Bainbridge Island
Metropolitan Park & Recreation District," with boundaries coextensive with the boundaries of the City and
governed by a board of five commissioners elected at large from within the district's boundaries pursuant to
RCW 35.61.050(2). If created, the metropolitan park district would be a governmental entity separate and
distinct from the City. It is the understanding of the City and the intent of the current Park District that the
metropolitan park district would assume the assets and functions of the existing Park District.
Section 2. Creation of Metropolitan Park District. If at the election a majority of the voters
voting thereon vote in favor of the formation of a metropolitan park district, it shall operate as a separate
entity independent of the City of Bainbridge Island, and that. the park district shall then be and become a
special municipal corporation and its name shall be "Bainbridge Island Metropolitan Park & Recreation
District".
Section 3. Board of Commissioners. There also shall be submitted in the same election to the
electorate and qualified voters of the City at the September 14, 2004 election, five specific commissioner
positions to be elected at large and serve as officers of the metropolitan park district as provided for by RCW
35.61.050. The election of park commissioners shall be null and void if the metropolitan park district is not
created.
Section 4. Effective Date. This resolution shall take effect upon its passage.
