ORDINANCE NO. 2023–29
AN ORDINANCE of the City of Bainbridge Island, Washington, amending the
Ferncliff Water Extension Surcharge Area Map adopted by Subsection
13.16.045.B of the Bainbridge Island Municipal Code and the Map and Property
List attached to Ordinance No. 2023-18 to add a parcel to be served by the
Ferncliff Water Extension.
WHEREAS, City of Bainbridge Island Ordinance No. 2023-18 added Section 13.16.045
to the Bainbridge Island Municipal Code (BIMC) to establish a water surcharge on properties to
be served by the Ferncliff Water Extension; and
WHEREAS, the current boundaries of the geographic area to which the surcharge
applies are established by a map attached as Exhibit A to City of Bainbridge Island Ordinance
No. 2023-18 and adopted by BIMC 13.16.045.B; and
WHEREAS, a list of properties included in the surcharge area is attached as Exhibit B to
Ordinance No. 2023-18; and
WHEREAS, since the adoption of Ordinance No. 2023-18, the City has received a
request to connect to the Ferncliff Water Extension from an owner of property located outside
the area established by the map and the City’s Public Works Director has determined that such
connection is feasible and that the property should be subject to the surcharge; and
WHEREAS, the Public Works Director has recommended, and the Bainbridge Island
City Council agrees, that the map adopted by BIMC 13.16.045.B should be amended to include
the property in the surcharge area and that the property should be included on the list attached as
Exhibit B to Ordinance No. 2023-18.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE
ISLAND, WASHINGTON, DOES ORDAIN AS FOLLOWS:
Section 1. Ferncliff Water Extension Surcharge Area. The Ferncliff Water Extension
Surcharge Area Map attached as Exhibit A to this ordinance is hereby adopted and BIMC
13.16.045.B is hereby amended to read to read as follows:
B. The boundaries of the geographic area to which this section applies
are shown on the map attached to City of Bainbridge Island Ordinance No. 2023-
18 2023-29, which is codified in this section. The map is adopted as part of this
code section as if fully set forth herein.
Section 2. List of Properties in Surcharge Area. This list of properties in the Ferncliff
Water Surcharge Area attached as Exhibit B to Ordinance No. 2023-18 is hereby amended to
read as set forth on Exhibit B to this ordinance.

Section 3. Severability. Should any section, paragraph, sentence, clause, or phrase of this
ordinance, or its application to any person or circumstance, be declared unconstitutional or
otherwise invalid for any reason, or should any portion of this ordinance be preempted by state
or federal law or regulation, such decision or preemption shall not affect the validity of the
remaining portions of this ordinance or its application to other persons or circumstances.
Section 4. Effective Date. This ordinance shall take effect and be in full force five (5)
days from its passage and publication as required by law.
