ORD 2001-49 SURFACE & STORMWATER MANAGEMENTORDINANCE 2001-49 AN ORDINANCE of the City of Bainbridge Island, Washington, relating to Surface and Stormwater Management, amending Section 15.20.020 and Section 15.20.060 of the Bainbridge Island Municipal Code. WHEREAS, Chapter 15.20 of the Bainbridge Island Municipal Code contains procedures for surface and storm water management; and WHEREAS, the City wants to have clear guidelines for the responsible maintenance and operation for all proposed and or constructed stormwater facilities and Best Management Practices (BMPs); now therefore, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Section 15.20.020, 62 of the Bainbridge Island Municipal Code is amended as follows: 62. "Storm water management manual" or "(manual)" means the manual adopted by reference and prepared by Washington State Department of Ecology, dated February 1992 Publication Number 91-75, which contains BMPs to prevent or reduce pollution. Section 2. Section 15.20.060, g., 8 and 10. of the Bainbridge Island Municipal Code is amended as follows: g. Small Parcel Requirement #7 - Other BMPs. Other appropriate BMPs to mitigate the effects of increased runoff will be required if the base requirements do not have sufficient protection or controls. Developers shall provide additional BMP's and systems for storm water control. 8. Minimum Requirement #8 - Off-Site Analysis and Mitigation. All development projects shall conduct an analysis of off-site water quality and quantity impacts resulting from the project and shall mitigate these impacts. The analysis shall extend a minimum of one-fourth of a mile downstream from the project. The existing or potential impacts to be evaluated and mitigated shall include, at a minimum, but not be limited to: a. Excessive sedimentation; b. Streambank erosion; c. Discharges to ground water contributing or recharge zones; d. Violations of water quality standards; e. Spills and discharges of priority pollutants. f. Minimum Requirement #10 - Operation and Maintenance. A complete operation and maintenance schedule shall be submitted to the Department of Public Works for all proposed and/or constructed storm water facilities and BMPs in accordance with BIMC 15.21. The operation and maintenance schedule shall be recorded as public record and include the executed Declaration of Covenant. The specific party (or parties) responsible for maintenance and operation shall be identified. This requirement shall become a condition of any new occupancy and enforced as outlined in BIMC 1.26. Section 5. Effective Date. This ordinance shall take effect and be in force five days from and after its passage, approval and publication as required by law.
