ORD 2005-11 AMENDING PARKING REQUIREMENTS IN BIMCORDINANCE NO. 2005-11 AN ORDINANCE of the City of Bainbridge Island, Washington, relating to revised policies of the 2004 Comprehensive Plan Update, amending Sections 17.04.040, 17.04.080, 17.04.085.C of Title 17; amending Sections 18.40.030, 18.41.030, 18.105.055.B, 18.105.060.C, 18.108.060.C, 18.108.030.B, 18.108.040, 18.85.070 to Title 18 of the Bainbridge Island Municipal Code WHEREAS, in accordance with RCW 36.70.A, the Growth Management Act, the City of Bainbridge Island adopted a Comprehensive Plan on September 1, 1994, subsequently amended, which guides the growth of the city, establishes the long range vision for the island and identifies the important characteristics that the community desires to retain, promote, and foster; and WHEREAS, in accordance with RCW 36.70A, the Growth Management Act, the City is required to review and update its Comprehensive Plan; and WHERAS, the 2004 Comprehensive Plan Update, adopting text amendments to the Comprehensive Plan and changes in land use designation to the official Land Use Map , was adopted on December 8, 2004 through City Council approval of Ordinance 2004-09; and WHEREAS, in order to implement certain policies amended by the 2004 Comprehensive Plan Update, Ordinance 2005-11 was drafted; and WHEREAS, the Planning Commission conducted a public hearing on Draft Ordinance 2005-11, on March 24, 2005, and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DO ORDAIN, as follows: Section 1. Section 18.41.030, Design Principles- Streetscape of the Bainbridge Island Municipal Code is amended as follows: 8. Bicycle Facilities Bicycle routes and storage racks should be provided, conveniently located near main entrances to buildings, and covered where possible. Covered racks can be incorporated into the building design, such as under roof eaves, to provide adequate cover. Section 3. Section 18.105.055.B of the Bainbridge Island Municipal Code is amended as follows: Comprehensive Plan Implementation Ordinance March 30, 2005 DRAFT 18.105.055 Submittal Requirements B. Application Submittal Requirements. An application for site plan and design review shall be filed with the department of planning and community development on forms provided by that department. All applications shall be accompanied by the fees as required by resolution, and shall include, but not be limited to, the following documents: 5. Scale drawings of the property depicting: a. North point and graphic scale; b. Boundaries, easements, and ownerships as set forth in the legal description, and easements on adjacent properties; c. Topography at appropriate contour intervals; d. Existing vegetation and significant trees as required by the landscape regulations, Chapter 18.85 BIMC; e. Watercourses, other natural features, and critical areas as required by Chapter 16.20 BIMC; f. Proposed open space area and type of open space as required by BIMC 18.105.050; g. Existing structures and improvements, including existing parking areas and the number of parking spaces; h. All proposed improvements including general building footprints and parking areas and the number of auto and bicycle parking spaces as required by BIMC 18.81; i. Sewage disposal system; j. Storm drainage design; k. Utilities plans, including existing and proposed hydrant locations; 1. Existing and proposed circulation systems on and off the site, including all adjacent streets and rights-of-way and auto, truck, emergency, pedestrian, bicycle and transit access; m. Landscaping plans, including street trees; n. Proposed land uses and densities on the subject property; and o. Other plans and drawings deemed necessary for evaluation; Section 4. Section 18.105.060.C of the Bainbridge Island Municipal Code is amended as follows: 18.105.060 Decision Criteria The development review committee (DRC), director, and planning commission shall base their respective recommendation or decision on site plan and design review on the following criteria: C. The locations of the buildings and structures, open spaces, landscaping, Pedestrian, bicycle and vehicular circulation systems are adequate, safe, ~nd efficient and in conformance with the Non-Motorized Transportation Plan; Section 5. Section 18.108.030.B of the Bainbridge Island Municipal Code is amended as follows: 18.108.030 Submittal Requirements B. Required information shall include but shall not be limited to: 3. A graphic scale drawing of the property indicating: f. Section 18.108.040 of the Bainbridge Island Municipal Code is amended as follows: 18.108.040 Decision Criteria A. A conditional use may be approved or approved with modifications if: 4. The conditional use is in accord with the comprehensive plan~ and other applicable adopted community plans, including the Non-Motorized Transportation Plan; Section 7. Section 18.85.070 of the Bainbridge Island Municipal Code is amended as follows: 18.85.070 Perimeter landscape requirements A. Intent. To provide a vegetated screen between uses or land use districts, to screen parking areas and structures located adjacent to public rights-of-way, and to allow visual and physical access to pedestrian and other non-motorized oriented uses, such as a multi-purpose trail or bikeway if those trails could be accommodated without compromising significant vegetation or hazardous slopes.. Section 8. Section 17.04.040 of the Bainbridge Island MuniciPal Code is amended as follows: 17.04.040 Definitions "Landscape perimeter" means a landscape buffer located along a subdivision boundary. The landscape perimeter may contain established native vegetation or additional landscaping. The landscape perimeter may contain multi-purpose trails or bikeways if those trails could be accommodated without compromising significant vegetation or hazardous slopes. Section 9. Section 17.04.080 of the Bainbridge Island Municipal Code is amended as follows: 7.04.080 Flexible lot - Standards A. Development Standards. Subdivisions established pursuant to the flexible lot design process shall be subject to the following development standards: 4. Landscape Buffers. b. Roadside Buffers. For all flexible lot design subdivisions located in the R-0.4, R-l, R-2 and R-2.9 districts where established vegetation of a forested nature is located adjacent to public roads that are designated as collector or arterial roads on the adopted road classification map, a 50-foot wide vegetative buffer shall be maintained. In the R-4.3 and R-3.5 districts a roadside buffer is not required unless it is.determined that a landscape buffer is necessary to maintain the character of the neighborhood or to reflect neighboring development patterns. The provisions for buffer averaging provided in subsection A.4.f of this section shall apply. The roadside buffer may contain multi-purpose trails or bikeways if those trails could be accommodated without compromising significant vegetation or hazardous slopes. Section 17.04.085.C of the Bainbridge Island Municipal Code is amended as follows: 17.04.085 Commercial and multifamily subdivision standards. C. Road, bicycle and pedestrian access performance standards pursuant to BIMC 17.04.080.C shall be satisfied, as applicable. Section 11. Relationship to other building and zoning provisions. To the extent that the requirements set forth in the provisions of this ordinance amending or adding sections to the Bainbridge Island Municipal Code are inconsistent with requirements set forth in other City code provisions, the requirements set forth in this ordinance shall supersede the requirements in the other City code provisions. Section 12. This ordinance shall take effect on and be in force five days fi:om and after its passage, approval, and publication as required by law.
