RES 2006-36 FINAL ASSESS/SEWER FACILITIES/LOCAL IMPROVEMENT DIST 20RESOLUTION NO. 2006-36 A RESOLUTION of the City Council of the City of Bainbridge Island, Washington, setting a time and place for Hearing on the Final Assessment Roll for Local Improvement District No. 20, directing that notice thereof be given in the manner required by law, and appointing and designating a Hearing Officer. WHEREAS, the Final Assessment Roll for Local Improvement District No. 20 which was crea ed and established by Ordinance No. 2003-38 for the purpose of improving four neighborhoods and an elementary school site by acquiring, constructing and connecting sanitary sewer facilities, all in accordance with Resolution No.. 2003-38 of the City Council, has been prepared as provided by law and is on file with the City Clerk at City Hall, 280 Madison Avenue North, Bainbridge Island, Washington, and it is necessary to set the time and place for a hearing thereon; and WHEREAS, the City Council is of the opinion that the hearing on such assessment roll should be held and conducted before a Hearing Officer and that such officer should be designated and appointed for that purpose to act in accordance with Ordinance No. 2006-14 (codified ;as BIMC Chapter 3.50); and WHEREAS, Rodney Kerslake is a Hearing Officer for the City of Tacoma and has conducted many public hearings for local improvement districts over the years for Tacoma and other Washington municipalities (i.e., hie recently conducted the Final Roll Assessment Public .Hearing for the South Lake Union Streetcar LID for the City of Seattle); and WHEREAS, Mr. Kerslake is willing to serve and perform the duties of the Hearing Officer for the Public Hearing on the Final Assessment Roll for Local Improvement District No. 20 in accordance with the attached "Hearing Officer Agreement for Local Improvement District No. 20"; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAIN13RIDGE ISLAND, WASHINGTON, AS FOLLOWS: Section I. The Public Hearing on the Final Assessment Roll for Local Improvement District No. 20 will be held and conducted before the Hearing Officer hereinafter designated and appointed, commencing at 6:00 p.m., Iocal time, on October 10, 2006, in the Council Chambers at City Hall. The City Clerk is authorized and directed to cause notice to be given both by mailing and pub] ication as required by law. Section 2. The City Council finds that Rodney Kerslake is a person qualified to conduct final assessment roll hearings, and he is designated and appointed to perform the duties of Hearing Officer with respect to the Final Assessment Roll Hearing in Local Improvement District No. 20, all as provided in Ordinance No. 2006-14 (codified as BIMC Chapter 3.50), and in accordance with the proposed "Hearing Officer Agreement for Local Improvement District No. 20," on file with the City Clerk:. Proper City officials are authorized and directed to do all things necessary to effectuate this appointment (including execution of said Hearing Officer Agreement) and facilitate arrangements for the Hearing. The foregoing resolution was ADOPTED by the City Council of the City of Bainbridge Islancl, Washington, at a regular open public meeting thereof, on the 9'h day of August, 2006.
