ORD 2006-12 AMENDING POL. W7.2 OF LAND USE ELEMNT OF COMP PLAN ORDINANCE 2006-12 An Ordinance of the City of Bainbridge Island, amending Policy W7.2 of the Land Use Element of the Comprehensive Plan to allow a density bonus in Urban Multifamily Districts in exchange for providing public amenities. WHEREAS, the City adopted a Comprehensive Plan and Land Use Map on September 1, 1994, subsequently amended, which designate the Urban Multifamily Districts as appropriate for multifamily residential use; and WHEREAS, the Urban Multifamily Districts are located within the area that the Comprehensive Plan designates for accommodating 50% of the Island's future population growth; and WHEREAS, the Housing Element of the Comprehensive Plan also includes goals and policies that speak to increasing the supply of multifamily housing in the City; and WHEREAS, allowing increased density in the Urban Multifamily Districts is consistent with Comprehensive Plan goals and policies; and WHEREAS, City policies and regulations currently allow for a density bonus in the Urban Multifamily Districts in exchange for providing affordable housing; and WHEREAS, a Comprehensive Plan amendment request (CPA13551) was submitted in 2005 that would add language to Land Use Element Policy W 7.2, allowing a density bonus in the Urban Multifamily Districts in exchange for providing public amenities; and WHEREAS, the Planning Commission and City Council reviewed Comprehensive Plan amendment request CP A13551 in accordance with the process specified in BIMC 18.117; now, therefore, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON DO ORDAIN, AS FOLLOWS: Section 1. Policy W7.2 of the Land Use Element of the Comprehensive Plan is amended to read as follows: W7.2. Retain the existing base densities of residential uses which range from 8 to a maximum of 14 units per acre within the Urban Multi-family Districts. To further the obiective of encouraging population growth in areas where urban services presently exist, a density bonus may be achieved in the Urban Multifamily Districts in return for providing public amenities beyond what is required to mitigate the development itself. 1 Public amenities are intended to enhance the livability of the urban areas while also benefiting the community in general, and may include providing public open space and pedestrian connections, or other public benefits as determined by the City Section 2. Severability. If any section, sentence, clause or phrase ofthis ordinance shall be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. Section 3. Effective Date. This ordinance shall take effect on and be in force five days from and after its passage, approval, and publication as required by law" PASSED by the City Council this 11 th day of October 2006.
