AN ORDINANCE of the City of Bainbridge Island,
Washington vacating that portion of Driscoll/Rainier
abutting Tax Lot No. 4135-000-110-0007, Tax Lot No.
4135-000-119-0008, Tax Lot No. 4135-000-122-0003, Tax
Lot No. 4135-000.-143-0107, Tax Lot No. 4135-000-144-
0007, and Tax Lot No. 4135-000-157-0100.
WHEREAS, Constance & Phillip J. Pons, the owners of Tax Lot No. 4135-000-
110-0007, John A. & Janis L. Chiarello, the owners of Tax Lot No. 4135-000-119-0008,
Bradley V. & Erik V. Clineschmidt, the owners of Tax Lot No. 4135-000-122-0003, Kelly
L. Lawson, the owner of Tax Lot No. 4135-000-143-0107, Thomas L. & Patricia J. Brant,
the owners of Tax Lot No. 4135-000-144-0007, Stephanie L. Harris & Juris G. Zommers,
the owners of Tax Lot No. 4135-000-157-0100, filed a petition with the City Council to
vacate that portion of Driscoll/Rainier abutting such real property; and

WHEREAS, the City Council fixed a public hearing on the petition before the
Council on July 12, 2006 at 7:00 p.m.
WHEREAS, the City Council held the hearing at the scheduled time, following
the hearing, submitted to the City Council proposed Ordinance 2006-21 vacating the
public right-of-way, and
WHEREAS, Constance & Phillip J. Pons, John A. & Janis L. Chiarello, Bradley
V. & Erik V. Clineschmidt, Kelly 1. Lawson, Thomas L. & Patricia J. Bryant and
Stephanie L. Harris & Juris G. Zommers have complied with the provisions of Chapter
12.34 of the Municipal Code, including payment of the full appraised value of the right-
of-way to be vacated; and
WHEREAS, the City Council desires to vacate the right-of-way; now, therefore,
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Vacation. That portion of Driscoll/Rainier abutting Tax Lot No. 4135-
000-110-0007, Tax Lot No. 4135-000-119-0008, Tax Lot No. 4135-000-122-0003, Tax
Lot No. 4135-000-143-0107, Tax Lot No. 4135-000-144-0007, Tax Lot No. 4135-000-
157-0100 is vacated to Constance & Phillip J. Pons, John A. & Janis L. Chiarello, Bradley
V. & Erik V. Clineschmidt, Kelly L. Lawson, Thomas L. & Patricia J. Bryant and
Stephanie L. Harris & Juris G. Zornmers; and as described on Exhibit A (legal
description) and depicted on Exhibit B (map) attached and incorporated by reference, is
vacated to the City of Bainbridge Island.
Section 2. Reservation of Easements. The City reserves and easement for the
operations and maintenance of overhead electrical power, utilities, and
telecommunications lines.
Section 3. Effective Date. This Ordinance shall be effective five (5) days from
and after its passage, approval, publication and posting as required by law.
