RES 2006-49 INCLUSION IN KITSAP CO PUBLIC TRANSPORTATION BENEFIT AREARESOLUTION NO. 2006-49 A RESOLUTION of the City Council of the City of Bainbridge Island confirming the City's desire to be included in the boundaries of the Kitsap County Public Transportation Benefit Area. WHEREAS, the Bainbridge Island City Council previously adopted Resolution No. 2006-45 by which it designated Darlene Kordonowy as the City's elected representative to attend and represent the City of Bainbridge Island at a Public Transportation Improvement Conference called by Kitsap County; and WHEREAS, the Public Transportation Improvement Conference convened on November 9, 2006, and considered the desirability of changing the boundaries of the Kitsap County Public Transportation Benefit Area known as "Kitsap Transit"; and WHEREAS, the Public Transportation Improvement Conference adopted a Resolution, a copy of which is attached hereto as Exhibit A, by which the Conference found it desirable to change Kitsap Transit's boundaries and scheduled a public hearing to consider fixing and establishing such changed boundaries; and WHEREAS, RCW 36.57A.030 requires each component City to advise the Kitsap County Board of Commissioners of its desire to be included or excluded from the Public Transportation Benefit Area; and WHEREAS, the Bainbridge Island City Council hereby finds it is in the best interests of the residents of Bainbridge Island to continue to be included within the boundaries of Kitsap Transit. THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DOES RESOLVE AS FOLLOWS: The City of Bainbridge Island hereby confirms its desire to be included within the boundaries of the Kitsap County Public Transportation Benefit Area known as Kitsap Transit. Lassoff, CMC City Clerk FILED WITH THE CITY CLERK: November 13, 2006 PASSED BY THE CITY COUNCIL: November 20, 2006 RESOLUTION NO. 2006-49 erh)A;A 4 RESOLUTION 2006-1 A Resolution Of The Kitsap County Public Transportation Improvement Conference Finding It Desirable To Change The Boundaries Of The Kitsap County Public Transportation Benefit Area And Fixing A Date For A Public Hearing WHEREAS, the Kitsap County Public Transportation Benefit Area was lawfully established in the early 1980s and is an active municipal corporation which operates under the name Kitsap Transit for the purpose of providing public transportation services in Kitsap County; WHEREAS, RCW 36.57A.020 and .030 confer on the Board of the Kitsap County Commissioners the authority, from time to time, to convene a Public Transportation Improvement Conference to consider changing the boundaries of Kitsap Transit; WHEREAS, on October 9, 2006, the Kitsap County Board of Commissioners adopted a resolution calling for the convention of a Public Transportation Improvement Conference (the "Conference") for the purpose of considering the desirability of adjusting the boundaries of Kitsap Transit and selected Commissioner Jan Angel as Kitsap County's representative; WHEREAS, the respective City Councils of the Cities of Bainbridge Island, Bremerton, Port Orchard and Poulsbo, by subsequent separate resolutions, each selected an elected representative to attend the Conference on behalf of each such City as follows: Bainbridge Island: Darlene Kordonowy Bremerton: Brad Gehring Port Orchard: Carolyn Powers Poulsbo: Connie Lord WHEREAS, notice of the Conference meeting was duly published by Kitsap County as required by law; WHEREAS, the Conference met on November 9, 2006, elected Jan Angel to serve as the Chairman of the Conference, designated Cathie Knox -Browning to serve as the Clerk, and voted to use Robert's Rules of Order to govern its procedures; WHEREAS, following the establishment of Kitsap Transit, the State Legislature enacted the Growth Management Act ("GMA"); WHEREAS, under GMA, urban governmental services should, with certain exceptions, be limited to urban growth areas; WHEREAS, under GMA, public transit service is an "urban governmental service", if provided at the intensity historically and typically provided in cities; WHEREAS, regular routed bus service is an urban governmental service; WHEREAS, historically, Kitsap Transit has confined its routed bus service operations to the more urbanized areas of Kitsap County; WHEREAS, the existing boundaries of Kitsap Transit include all of Kitsap County, which include large areas outside of both existing urban growth areas and areas that are projected to be included in subsequent urban growth area expansions within a relative short-term future; WHEREAS, over the past twelve (12) months, Kitsap Transit's Board of Commissioners and executive officers have considered and studied the potential change to the boundaries of Kitsap Transit and, as a result of those efforts, made certain preliminary recommendations regarding the desirability of changing its boundaries; WHEREAS, Kitsap Transit's preliminary recommendations were submitted to the review of the Kitsap County Department of Community Development for consistency with the projected Urban Growth Area expansions contemplated by Kitsap County's 10 year Comprehensive Plan update now being undertaken and were also submitted to the Elections Division of the Kitsap County Auditor's Office to determine practicability of following Urban Growth Boundaries versus voter precinct or school district lines; WHEREAS, as a result of the comments and input of those two departments, Kitsap Transit is recommending that its boundaries be changed in accordance with the "Transit District Boundary Adjustment Map" and "Description" attached as Exhibit A hereto; WHEREAS, in its presentation to the Conference, Kitsap Transit has represented that its requested boundary changes will not result in any change to any existing transit services or programs provided to the residents of Kitsap County and its Component Cities; specifically Kitsap Transit has represented it will continue to provide ACCESS and Rideshare services beyond its boundaries as authorized by law. WHEREAS, the Conference finds it desirable to change the boundaries of Kitsap Transit; NOW, THEREFORE, BE IT RESOLVED that the Kitsap County Public Transportation Improvement Conference shall hold a Public Hearing on December 12, 2006 at the hour of 6 p.m. at the Kitsap County Administration Building, 614 Division Street, Port Orchard, Washington, to consider fixing and establishing the boundaries of Kitsap Transit; and it is FURTHER RESOLVED that the Clerk of the Conference shall publish Notice of the Public Hearing in the Kitsap Sun for four (4) consecutive weeks as required by and in conformance with RCW 36.57A.030. ADOPTED by the Kitsap County Public Transportation Improvement Conference at a regular meeting thereof, held on the 9th day of November, 2006.
