RES 2004-13 STETSON RIDGE II SUBDIVISION PRELIMINARY PLAT APPROVALRESOLUTION NO. 2004-13 A RESOLUTION of the City of Bainbridge Island, Washington approving The Stetson Ridge II subdivision preliminary plat (Case No. SUB 12338). WHEREAS, on May 22, 2003, a preliminary plat application was submitted by Stetson Development Company II, LLC to the Department of Planning and Community Development; and WHEREAS, the preliminary plat application facilitates creation of 12 residential lots with open space on a 11.45 acre parcel located on the east side of Doris Street (to be renamed Ridge Lane), about a quarter mile north of the Doris StreetBucklin Hill Road intersection; and WHEREAS, the Department of Planning and Community Development reviewed and forwarded its recommendation for conditional approval to the Hearing Examiner; and WHEREAS, on October 28, 2003, the Hearing Examiner conducted a public hearing on the preliminary plat upon proper notice; and WHEREAS, on March 19, 2004, the Hearing Examiner recommended conditional approval of the preliminary plat and entered her Findings of Fact, Conclusions of Law and Recommendation; now, therefore, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DOES RESOLVE AS FOLLOWS: Section 1. The Findings of Fact, Conclusions of Law and Recommendations of the Hearing Examiner (File No. SUB12338), as set forth in Exhibit "A", which is attached and incorporated by reference, is adopted as the final decision of the Bainbridge Island City Council with the following conditions added: Condition No. 40. The following note shall be placed on the final plat mylar: Open Space Tract No. B is to be developed with a stormwater detention facility. The open space tract, excluding the actual detention facility, shall be maintained in native vegetation. If the open space tract is fenced, chain link, cyclone and other metal mesh fencing shall not be utilized. Condition No. 41. The following provision shall appear as a note on the final plat mylar and included in the Open Space Management Plan: The existing vegetation on Open Space Tracts A, C and D shall be retained, except that hazard trees may be removed in accordance with the procedures stipulated in BIMC 18.85.070. Section 2. The proposed preliminary plat is in conformance with the zoning ordinance, the comprehensive plan, the subdivision regulations and standards, and all applicable land use ordinances and applicable state law in effect at the time the fully completed application for preliminary plat approval was submitted by Stetson Development Company II, LLC to the Department of Planning and Community Development. Section 3. The final plat of the Stetson Ridge II Subdivision shall state on its face that it is subject to the conditions of approval set forth in the resolution.
