RES 2004-15 FERNCLIFF AVENUE LCARESOLUTION NO. 2004-15 A RESOLUTION of the City of Bainbridge Island, Washington, setting a public hearing on a Latecomers reimbursement charge for a portion of Ferncliff Avenue. WHEREAS, Landmark Development, the developer of Woodland Village, entered into a City Standard Developer Agreement to install utilities (water & sewer) on a portion of Ferncliff Avenue, a public Rights -of -Way; and WHEREAS, the Developer requests approval of the City's standard Latecomers Agreement (LCA) to partially recover some of the capital costs from adjoining property owners who may benefit from connecting to the new utilities; and WHEREAS, the City notified properties within the latecomers area of the Latecomers Agreements in accordance with BIMC 13.32.170; and WHEREAS, the City received a request for a hearing before the City Council from a property owners in the latecomers area in accordance with BIMC 13.32.170; and WHEREAS, a Public Hearing is required to formalize such Latecomers Agreement, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DOES RESOLVE AS FOLLOWS: Schedule a Public Hearing for such a latecomer's agreement before the City Council as part of their regular council meeting on Wednesday, June 23, 2004 starting at 7:00 p.m. 2. Direct the City Clerk to provide notification of said public hearing. PASSED by the City Council this 26th day of May, 2004. APPROVED by the Mayor this 27th day of May, 2004.
