ORD 2000-32 GEORGE STREET VACATING A PORTIONORDINANCE NO. 2000 -32
AN ORDINANCE of the City of Bainbridge Island, Washington
vacating a portion of George Street.
WHEREAS, a petition to vacate a portion of George Street was filed with the City;
WHEREAS, Richard Barbieti & Cara Lyn Tangen, the owners of Tax Lot No. 4189-
003-001-0008, and Richard Barbieri, owner of Tax Lot No. 4478-000-001-0004, which lots are
the sole properties abutting the portion of George Street requested to be vacated;
WHEREAS, on June 14, 2000, the City Council adopted Resolution No. 2000-21,
setting a public heating before the Public Works Committee on the proposed right-of-way
vacation for July 17, 2000;
WHEREAS, on July 17, 2000, the Public Works Committee held a public heating on the
issue of whether the City should vacate a portion of George Street;
WHEREAS, on July 31, 2000, the Public Works Committee recommended approval of
this road vacation;
WHEREAS, the City Council determined that it is in the best interests of the public
health, safety and welfare to vacate a portion of George Street;
WHEREAS, the proposed vacation of George Street will enable the City to implement a
plan that provides comparable or improved public access to the same general shoreline area to
which George Street abuts; and
WHEREAS, pursuant to BIMC 12.34.130 and 12.34.150, Richard Barbieri & Cara Lyn
Tangen have paid the City the required compensation for the property to be vacated and have
otherwise complied with the provisions of Chapter 12.34 BIMC; now, therefore
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND,
WASHINGTON, DO ORDAIN AS FOLLOWS:'
Section 1. That portion of the fight-of-way known George Street, which abuts Tax
Lot No. 4189-003-001-0008 and Tax Lot No. 4478-000-001-0004, and as depicted on Exhibit A,
attached and incorporated by reference, is vacated to Richard Barbieri & Cara Lyn Tangen.
Section 2. The City Clerk is authorized and directed to record a certified copy of this
ordinance with the Kitsap County Auditor's office.

Section 3. This Ordinance shall be effective five (5) days from and after it's passage,
approval, and publication as required by law.

Beginning at a stone plat monument of record at the intersection of the platted centerlines of
George Street and Park Boulevard, thence South 89°01 '24" East along the northerly limits of said
plat 17.82 feet to a point of curve, the center of which, being the northwesterlymost corner of Lot
23. Block 2, said plat, bears South 0°58'36.. west: thence along a 30.00 foot radius curve to the
left. having a central angle of 20°00'56.. and an arc distance of 10.48 feet to a point of compound
curve; thence along a 90.00 foot radius curve to the left, having a central angle of 31 ° 11'58" and
an arc distance of 49.01 feet; to a point on the southerly margin of said George Street produced
easterly; thence North 89°01 '24" West along the southerly margin of said George Street and the
easterly prolongation thereof 211.27 feet; thence North 75 ° t 5 '53" East 19.50 feet; thence North
40°58"57' East 32.28 feet to a point on the northerly limits of said plat; thence South 89'01 '24"
East along said northerly limits 221.37 feet to the True Point of Beginning.
