ORD 2001-32 BLAKELY HARBOR MORATORIUMORDINANCE NO. 2001-32 AN ORDINANCE of the City of Bainbridge Island, Washington, imposing a moratorium on shoreline substantial development applications for construction of new docks and piers in Blakely Harbor. WHEREAS, there are a few docks and piers in Blakely Harbor; and WHEREAS, no new clocks or piers have been constructed in Blakely tarbor in the last 30 years; and WI IEREAS, the City' needs additional time to study and analyze the , umulative impact of docks and piers in Blakely Harbor; and WHEREAS, RCW 35A.63.220 and RCW 36.70A.390 authorize the City to 2dopt a moratorium on development and to hold a public hearing on the moratorium within 60 days of the commencement of the moratorium; and WHEREAS, the City Council has determined that a moratorium on , onstruction of new docks~and piers in Blakely Harbor is necessary for the protection of the public health, safety, property or peace; now, therefore TI-[E CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, DO ~ )RDAIN AS FOLLOWS: Section 1. Imposition of Moratorium. A moratorium is imposed on the tiling c;f shoreline substantial development applications for construction of new docks and piers as defined in the Shoreline Master Program in Blakely Harbor, as described in Exhibit A. Section 2. Term of Moratorium. The moratorium imposed in this . ~rdina~ce shall become effective and be in force five days from and after its passage, approval and publication and shall continue in effect until and including February 8, 2002, unless repealed, extended or modified by the City t.:ouncil after subsequent public hearing and entry of appropriate findings of fact pursuant to RCW 35A.63.220. Section 3. Severabilit'~. If any section, sentence, clause or phrase of this ordinance shall be h~ld to be invalid or unconstitutional by a court of competent jurisdiction such invalidity or unconstitutionality shall not affect the validity or t onstitutionality of any o~her section, sentence, clause or phrase of this ~rdinance. Section 4. Effective date. This ordinance shall take effect and be m force five days from and after its passage, approval and publication as required by law.
