ORDINANCE NO. 2005-35
AN ORDINANCE of the City of Bainbridge Island, Washington granting a
right-of-way vacation for a portion of Donald Avenue
abutting Tax Lot No. 4115-004-007-0009
WHEREAS, this vacation is for a portion of Donald Avenue abutting City owned
property. This vacation will accommodate the property needed for the Winslow Wastewater
Treatment Plant project; and
WHEREAS, notice has been posted and published according to law; and
WHEREAS, the City Council fixed a public hearing before the City Council on
October 26,2005:, and
WHEREAS, the City Council held the hearing at the scheduled time, and
WHEREAS, the City Council desires to vacate the right-of-way; now, therefore,

THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Vacation. That portion of Donald Avenue abutting Tax Lot No 4115-004-
007-0009, and as described on Exhibit A (legal description) and depicted on Exhibit B, (map)
attached and incorporated by reference, is vacated to The City of Bainbridge Island.
Section 2. Reservation of Easements. The City reserves an easement for the
operations and maintenance of overhead electrical power and telecommunications lines.
Section 3. Effective Date. This Ordinance shall be effective five (5) days from and
after it's passage, approval, publication, and posting as required by law.
PASSED by the City Council this 9th day of November, 2005
APPROVED by the Mayor this 10th day of November, 2005

AVENUE
PLAT OF WILLIAMS EAGLE HARBOR PARK
All those portions of Donald Avenue, plat of Williams Eagle Harbor Park,
volume 3 of plats, page 89, records of Kitsap County, Washington, that would
attach by operation oflaw, fronting the east 30 feet of Lot 7, Block 4, said plat
and fronting lots 8 through 12, said Block 4 and the westerly 25.65 feet of lot
13, as measured perpendicular to the line dividing lots 12 and 13, said Block 4;
also those portions, that would attach by operation oflaw, fronting Lot 8, except
the west 30 feet thereof, and lots 9 and 10, Block 5 of said plat.
