ORD 2005-39 FERRY-RELATED PARKING POLICIES IN MASTER PLAN AMENDMENTS
ORDINANCE NO. 2005-39 (formerly 2004-18)
AN ORDINANCE ofthe City of Bainbridge Island,
Washington, amending ferry-related parking
policies in the Winslow Master Plan.
WHEREAS, the City adopted a Comprehensive Plan on September 1, 1994, which
establishes goals and policies for managing the land, shoreline and resource areas of
Bainbridge Island, including the Mixed-Use Town Center and the Ferry Terminal Overlay
District; and
WHEREAS, the City adopted an update to the Comprehensive Plan on December
8, 2004, which did not modify ferry-related parking policies; and
WHEREAS, the Comprehensive Plan contains policy W3.2, which calls for
limiting commuter parking and locating parking underground of new development and in
garages within the FelTy Tenninal Overlay District; and
WHEREAS, the City adopted the Winslow Master Plan on May 21, 1998, which is
a sub-element of the Comprehensive Plan that fmiher establishes policies for managing the
land and shoreline areas of the Mixed-Use Town Center and High School Road Districts,
including the Ferry Tenninal Overlay District; and
WHEREAS, the City adopted Ordinance 99-32A on October 27,1999, which
amended ferry-related parking policies in the Winslow Master Plan for the Ferry Terminal
Overlay District in response to a remand from the Central Puget Sound Growth
Management Hearings Board; and
WHEREAS, the vision set forth for the Ferry Tenninal Overlay District by the
Comprehensive Plan and the amended Winslow Master Plan is for the district, now
dominated by surface parking lots, to become a new urban mixed-use neighborhood with
parking integrated within or under buildings and adjacent garages.

WHEREAS, the Winslow Master Plan felTy-related parking policies, as
amended, established fixed numerical caps on the number of felTy-related parking within
the Ferry Terminal Overlay District; and
WHEREAS, numerical caps on ferry-related parking within the FelTY Tem1inal
Overlay District where integrated into the City's Zoning Code by Ordinances 96-08, 99-
17, 99-64, 2000-10, which are not affected by this ordinance; and
WHEREAS, at the request of the Mayor, the Department of Planning and
Community Development submitted a Comprehensive Plan Amendment application on
June 28,2002 requesting a review of the Winslow Master Plan numerical caps on ferry-
related parking because they create inflexibility, make it difficult to plan for growth or
respond to changing circumstances, and are largely duplicative to the provisions of the
Zoning Code, where such specific provisions are more appropriate;
WHEREAS, The Planning Commission conducted a Phase-I Comprehensive
Plan Amendment review and on November 21,2002 recommended a Phase-II review;
and
WHEREAS, the City Council conducted a Phase-I Comprehensive Plan
Amendment review and on April 23, 2003 recommended a Phase-II review; and
WHEREAS, the Planning Commission conducted a Phase-II review and held a
public hearing on August 26, 2004 that was continued to September 23, 2004;
WHEREAS, the City Council conducted a Phase-II review; now, therefore
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND,
WASHINGTON, DOES ORDAIN, AS FOLLOWS:
Section 1. The Winslow Master Plan land use policies pertaining to the Ferry Terminal
Overlay District as adopted in section 3 of Ordinance 99-32A are amended as follows:
Ferry Terminal- General
. All development shall include at least 10'% of landscaped or naturally vegetated
open space (parking may be located under the open space.)
. Commuter parking located in the Ferry Terminal District shall be limited 111
number and/or area to achieve the following objectives:
. Protect the character of the district from being further dominated by
Q1!.rking;
· Encourage the redevelopment of the district;
· Limit traffic impacts within the Ferry Terminal District, Winslow, and
Island-wide; and

· Encourage transit, non-motorized, and other travel methods as
altematives to low-occupancy vehicles;
· The number of commuter parking spaces located in the Ferry Terminal District is

Terminal District. Commuter parking spaces that are not shmvn on Figure 1 g are
not allo'.ved in the Ferry Terminal District..
· Allow iffi additional ~ parking spaces in structured parking in the Ferry
Terminal District for use by non-commuter ferry passengers in off-peak hours
(e.g., after 9:00 a.m.), when constructed in conjunction with placement of an
equivalent amount of existing surface ferry parking in structure. No property
o\vner of an existing surface parking lot may increase the total number of spaces
by more than 225 additional non commuter parking spaces.
· Establish F ARs as shown in Table 2.
Ferry Terminal - North of Winslow Way
· Non-residential uses are permitted as follows: 1) Commuter-oriented retail and
commuter-oriented services may be located only along Winslow Way, within
100' north of Winslow Way, with no single use larger than 2,000 square feet.
Buildings shall have customer entrances on Winslow Way. 2) Personal and
professional services may be located only along Winslow Way, within 100' north
of Winslow Way. Buildings shall have customer entrances on Winslow Way. 3)
There is no restriction on the location of daycare. 4) Govemment, educational,
cultural and religious institutions are not pennitted north of Winslow Way.
. A one hundred foot wide transition area establishing standards for landscaped
buffers and lower height limits shall be applied as follows: along the west side of
Femcliff Avenue; the north boundary of the district, east of Cave Avenue; and
along both sides of Cave Avenue, starting approximately 300 feet north of
Winslow Way. The purpose of these transition standards is to protect adjacent
residential neighborhoods from adverse impacts of development. The transition
area is illustrated in Attachment 1 to this Ordinance.
. Should parking needed to serve commercial development not be fully utilized by
a development, then the unused parking may be converted to non-commuter ferry
parking. The property owner would need to demonstrate that the parking was not
needed for the commercial uses. (Allowing unused parking spaces designated for
commercial use to be conveI1ed to non-commuter ferry parking could encourage
commercial uses that generate minimal traffic.)
Ferry Terminal- South of Winslow Way
. Permit only commuter-oriented retail serVIces, with no single use larger than
2,000 square feet.
. A hotel or inn is permitted south of Winslow Way, with public access to exterior
open space and limited parking.
. Govemment, educational, cultural and religious institutions are conditional uses
south of Winslow Way.

· Developments south of Winslow Way shall include pedestrian walkways that
connect to Winslow Way East and Olympic Drive Southeast, and/or that align
with Cave Avenue and Femcliff Avenue.
Section 2. The Winslow Master Plan transportation policies regarding parking in the
Ferry Terminal Overlay District as adopted in section 4 of Ordinance 99-32A, are
amended as follows:
Parking - Commuter
In conjunction with future development of the Ferry Terminal District and in
cooperation with private development interests and Washington State Ferries,
structured parking would be developed to incorporate the number of existing spaces
available during the a.m. peak hours (e.g., to 9:00 a.m.). AH- aAdditional ~spaces
may be developed in the Ferry Terminal District for ferry users arriving after the a.m.
peak hours. Development of these ~spaces would be offered as an incentive to
encourage locating the existing ferry parking within a parking structure. The
structure would be suitable for air rights development consistent with underlying
zoning (see also Ferry District discussion). At no time ','/auld a.m. peak supply in the
Ferry Tem1inal District exceed 1,121 spaces (i.e., no more spaces can be built than
are being roplaced). (An additional 173 spaces are located in thG Gateway District).
See Figure 18 which delineates the location of existing ferry-related parking.
Section 3. Severability. If any section, sentence, clause or phrase of this ordinance
shall be held to be invalid or unconstitutional by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of any
other section, sentence, clause or phrase of this ordinance.
Section 4. Effective Date. This ordinance shall take effect on and be in force five days
from and after its passage, approval, and publication as required by law.
