RES 2001-02 FAR BONUS (AMENDING FEES FOR PURCHASING THE RIGHT TO DEVELOP)RESOLUTION No. 2001-02 A RESOLUTION OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON AMENDING THE FEES FOR PURCHASING THE RIGHT TO DEVELOP BONUS FLOOR AREA RATIO IN THE MIXED USE TOWN CENTER AND HIGH SCHOOL ROAD DISTRICTS, AND AMENDING SECTION 9 OF THE BAINBRIDGE ISLAND FEE SCHEDULE. WHEREAS, in accordance with Policy W 1.7 of the Comprehensive Plan the City undertook the development of the Winslow Master Plan and subsequently amended the Comprehensive Plan to incorporate the recommendations of the Master Plan; and WHEREAS, the Winslow Master Plan establishes floor area bonuses in the Mixed Use Town Center and High School Road Districts as a means to conserve agricultural land and develop public amenities; and WHEREAS, in 1999 the City Council passed Ordinance 99-17 to implement to the Winslow Master Plan providing for these charges; and WHEREAS, the Finance & Personnel Committee of the City Council has verified the amounts reported by the City's consultant on this subject in 1998, Property Counselors, and recommends current fees that reflect 80 % of the current fair market value of the floor area ratio bonuses being provided; and WHEREAS, the City Council has determined that the fees set by Resolution 99- 24 for floor area ratio bonuses do not presently reflect market conditions; now, therefore, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DOES RESOLVE AS FOLLOWS: Section 1. Section 9 of the Bainbridge Island Fee Schedule is amended to read as follows: 9. BUILDING & PLANNING FEES (Resolutions 99-26 and 2000-33 unless otherwise indicated) The charges in this section are in addition to any applicable charges in other sections. For applications covered by the hourly rate, a deposit equal to twenty hours' charge shall be collected before the application is accepted for all applications except boundary line adjustments, conditional use permits, and two -lot short -plats, in which case a deposit equal to ten hours' charge shall be collected or site visits and consultation in which case a deposit equal to two hours' charge shall be collected. Any unspent amount from such a deposit shall be refunded to the applicant within 60 days from the final action on the application. Amounts paid for applications prior to November 1, 1999, shall be treated as deposits against the subsequent rates with the provision that refunds of amounts paid prior to November 1, 1999 shall not be made unless the requested permit is withdrawn by the applicant prior to any significant work being done on it. (Credits for payment before November 1, 1999 do not apply to Engineering Fees). See Ordinance 99-47 for additional information on Hourly Rates.
