RES 2006-16 DNS ISSUED BY WSFRESOLUTION NO. 2006-16
A RESOLUTION ratifying three motions passed by City Council on
March 21, 2006, concerning actions to be taken in
response to a March 8, 2006 DNS issued by the
Washington State Ferries.
WHEREAS, on March 8, 2006, the Washington State Ferries issued a
Determination of Non -Significance ("DNS") concerning certain planned
improvements to the Eagle Harbor Maintenance Facility; and
WHEREAS, on March 21, 2006, and as part of a special meeting, the
Mayor and City Council held an executive session to discuss potential litigation
issues concerning said DNS; and
WHEREAS, following said executive session, a short open public
meeting of City Council was held, during which the following three motions
were considered and approved by a unanimous vote of City Council:
(1) Council Member Tooloee moved that the City be authorized to file an
appeal with the appropriate reviewing agency and/or court for said DNS
on the basis of all appropriate and necessary appeal grounds. The
motion was seconded by Council Member Snow.
(2) Council Member Tooloee moved that the City should take all necessary
steps to assume lead agency status regarding the enviromnental review
process concerning all proposals to improve, maintain, develop or
expand the Washington State Ferry facility on Eagle Harbor,
Washington. The motion was seconded by Council Member Snow.
(3) Council Member Vancil moved that the City Council submit comments
on said DNS to the City Planning Department no later than March 22,
2006. The emotion was seconded by Council Member Tooloee.
WHEREAS, attached for City Council consideration and approval is a
resolution that ratifies the actions of City Council to approve said motions, now,
therefore
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND
DOES RESOLVE AS FOLLOWS:
The three motions passed by City Council on March 21, 2006,
concerning actions to be taken in response to a March 8, 2006 DNS issued by
the Washington State Ferries are hereby approved and ratified.
