ORD 2007-15 SALARIES FOR ELECTED OFFICIALS
ORDINANCE NO. 2007-15
AN ORDINANCE of the City of Bainbridge Island, Washington, relating
to the Salary Commission, Chapter 2.74 of the Bainbridge Island
Municipal Code; amending sections 2.74.010, 2.74.020, 2.74.040, and
2.74.050 ofBIMC Chapter 2.74; and repealing section 2.74.051 ofBIMC
Chapter 2.74.
WHEREAS, the process of establishing salaries for elected officials should be open,
transparent, and accountable to the electorate; and
WHEREAS, the City recognizes the need for adequate and fair compensation for its
elected officials; and
WHEREAS, the City recognizes the resources of time and energy required of elected
officials to perform the duties of their office; and
WHEREAS, the City believes that the demands required of elected officials in achieving
its Mission and the Vision of the Comprehensive Plan, and managing its growth in a thoughtful,
foresighted, balanced manner make it unique among cities of its size; and
WHEREAS, the City desires to attract a diverse pool of aspirants to public office; now,
therefore
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1.

"2.74.010 Created - Membership, appointment, compensation, term.
A. There is created a salary commission for the city. The commission shall
consist of seven members, to be appointed by the Mayor with the approval of the
city council.

Section 2.74.010 of the Bainbridge Island Municipal Code is amended as

former City Couneil members.
1. Two members appointed bv the Mayor from Bainbridge Island's
citizenry at large.
B. A member of the commission shall serve for a three-year term without
compensation, and shall be a resident of the city. The initial members shall be
appointed for staggered tenDS. The existinc staggered terms shall be filled as they
expire as set forth in Section .^.. in the order listed.
C. No member ofthe commission shall be appointed to more than two terms.
D. A member of the commission shall not be an officer, official, or employee
of the city or an immediate family member of an officer, official, or employee of
the city. For purposes of this section, "immediate family member" means the
parents, spouse, siblings, children, or dependent relatives of an officer, official, or
employee of the city, whether or not living in the household of the officer,
official, or employee."
Section 2. Section 2.74.020 of the Bainbridge Island Municipal Code is amended as
follows:
"2.74.020 Vacancies.
In the event of a vacancy in office of commissioner, the mayor shall appoint.
subiect to approval of the city council. a person to serve the unexpired portion of
the tenn of the expired position it shall be filled to accomplish the eommission
composition established in Seetion l\, 2.71.010."
Section 3. Section 2.74.040 of the Bainbridge Island Municipal Code is amended as
follows:
"2.74.040 Duties Mission and Responsibilities.
A. The commission shall have the duty. at such intervals as determined by the
commission. to review the salaries paid by the city to each elected city official. If
after such review the commission detennines that the salary paid to any elected
city official should be increased or decreased. the commission shall file a \\Titten
salary schedule with the city clerk indicating the increase or decrease in salary.
The Commission is charged ","ith the responsibility of making written
reoommendations on appropriate levels of salary ai'ld benefits for sleeted officials.
B. Any increase or decrease in salarv established by the commission shall
become effective and incorporated into the city budget without further action of
the city councilor the commission. The Commission shall conduct a minimum of
five meetiHgs bet'lleEm July 1 afld September 30 of eaoh odd numbered year.
C. Salarv increases established by the commission shall be effective as to all
city elected officials. regardless of their terms of office. The Commission's
missiofl is limited to prepariflg aad flreseBtiBg a study of the com-pensatioB afld
benefits of the elected officials of the City of Bainbridge Island.
D. Salary decreases established by the commission shall become effective as
to incumbent city-elected officials at the commencement of their next subsequent
temlS of office."
Section 2.74.050 of the Bainbridge Island Municipal Code is amended as
Section 4.
follows:
"2.74.050 Referendum OperatiBg CuideliBes.
Any salary increase or decrease established by the commission pursuant to
this chapter shall be subiect to referendum petition bv the voters of the city. in the
same mmmer as a city ordinance. upon filing of a referendum petition with the
citv clerk within 30 days after filing of a salary schedule by the commission. In
the event of the tiling of a valid referendmll petition, the salary increase or
decrease shall not go into effect until approved by a vote of the people.
Referendum measures under this section shall be submitted to the voters of the
city at the next following general or municipal election occurring 30 days or more
after the petition is tiled. and shall otherwise be governed bv the provisions of the
State Constitution mId the laws generally applicable to referendum measures.

1. The nature and appropriateness of elected officials' compensation
should be addressed in a broad sense, and shall include how such compensation is
related to the concept of public ser/ice.
2. Comparisons should be made tEl other similar boards, executives, and
commissioBs v:ith regard to d1:lties, respElBsibilities aBd the number of hours,
meetings, and forgElne eareer commitments required to perform the job.
3. .\s appropriate, SUi'Veys of other boards, councils, and eommissions
should be considered in makiBg recommenElations.
1. The Commission \':ill hold at least ElFie public hearing tEl allow citizens

elected officials' eompensation.
5. Meetings will be opeB to the public. Unless otherwise indicated, the

6. The Commission will flrepare its reflort afld reeommendations within 7
days oft-he cOFiehwion Elf its deliberations."
Section 5. Section 2.74.051 of Chapter 2.74 of the Bainbridge Island Municipal Code
is hereby repealed.
Section 6. If any section, subsection, paragraph, sentence, clause or phrase of this
ordinance is declared invalid or unconstitutional for any reason, such decision shall not affect the
validity ofthe remaining portions of this ordinance.
Section 7. This ordinance shall take effect and be in force five days after its
passage, approval and publication as provided by law.
