ORD 2009-38 STORM AND SURFACE WATER UTILITY FEEORDINANCE No. 2009-3
AN ORDINANCE of -the'City of Bainbridge Island, Washington,
= increasing, the -City's and water Utility fee; a.d
amending Sections -13.'24.065 and 13.24.0'70 of Chapter 13.24 of
the -Bainbridge Island M ieip l-Cdde.
A REAS, RCW Chapter 35.67 provides that, cities are authorized to establish storm
water "storm 'sewer" utilities; and
WHEREAS, the City of Bainbridge Island has had a Storm and Surface Water
Management (formerly "Storm Drain") utility since 1957; and
WHEREAS, the City caused to be published in the City's legal newspaper a notice of
public hearing on storm and surface water utility fees to be hold on I e em. er 9,. 2009, now,
therefore, ,
THE CITY COUNCIL of THE CITY OF BAINBRIDGE ISLAND,
WASHINGTON, DOES ORDAIN AS FOLLOWS:.
Section 1. Section 13.24.065 of Chapter 13.24 of the Bainbridge Island Municipal Code
is hereby amended to read as follows:
"13.24.065 Automatic annual fee adjustment.
E The fees described in BIMC 13.24.0701, as now existing and as subsequently
amended, shall be adjusted on an annual basis beginning January I" of each
year, unless the City council determines by December 31 " of any year that
the adjustment shall he another amount or shall not occur for the next year.
The adjustment shall be equal to the annual gate of increase in the Seattle
Area Consumer Price Index."
Section 2. Section 13.24.0 '0 of Chapter 13.24 of the Bainbridge Island Municipal Code
is hereby amended to read as follows:
"13.24.0 70 Single-family and duplex residential fees.
The monthly service fee for each single-family and duplex residential
dw lling from January 1, 2-0042010, through December 31, 20082010. Tall
be $42-.4-713.21; provided that the ratio of impervious to pervious surface of
the lot shall not exceed 50 percent. If the -ratio of impervious to pervious

surfaces exceeds 50 percent, the rate established in BIMC 13.24.080 sheall

Section 3. This ordinance shall 'take effect and be. in force on January 1, 2010 after its
Passage, approval and publication as provided y law. -±
