ORD 2009-40 WATER SERVICE RATESORDINANCE NO, 2009-40. AN ORDINANCE the City of Bainbridge Island, Washington, . relating to the City Water Utility; setting water service 'rates and amending Section 13.16.060 of BIMC Chapter 13.1 6, automatic annual fee adjustment, 'RAS, a structure for establishing water and suer rates, charges, and fees was established by Ordinance No. 2-20; and WHEREAS, ordinance No. 2-20 was subsequently amended; an WHEREAS, Section 13.1 .o o of BIMC Chapter 13.16 provides for an automatic annual fee adjustment; and WHEREAS, the City has engaged Financial Consulting Solutions Group, Inc., t perform a Water Utility late Study and Analysis to recommend a rate structure which will provide for utility rates adequate to ensure that the Water Utility segment is fully self-supporting; and WHEREAS, the study performed by Financial Consulting Solutions group, Inc, considered the cost o' f needed capital improvements and operations and has recommended conservation rate structure with no overall rate increases for the years 2010 through 2014; and WHEREAS, based on the recommendations of the Utility Advisory Committee, the City Couneil has determined that the Cit '.s water rates should be held at the 2009 level and structure until the Utility Advisory Committee can further review the proposed conservation rate structure; and WHEREAS, the City caused to be published in the City's legal, newspaper a notice of public hearing on Water -rates to be held on November 23, 2009 which was continued to December 2, 2009; and now, therefore, THE CITY COUNCIL of THE CITY OF BAINBRIDGEISLAND, WASHINGTON, DO ORDAIN AS LOWS: Section 1. Section 13, 16.060 of BIMC Chapter 13.1 6, automatic annual fee adjustment, is amended to read as follows: "13.16.060 Automatic annual fee adjustment, A. All rates described in Section E of Ordinance 82-20, as amended, shall b subject to an adjustment beginning with the January billing period of each year equal to the annual percentage increase in the United States Consumer lace Index, All Urban Consumers (CPI -,U) for November of the preceding year as shown in the release from the Bureau of Labor Statistics plus two percent unless the city council determines by December 3 It of any, year that the adjustment shall_ be another amount or shall not occur for the next year. . The January billing period -for .those rates ba. ed o meter readings will begin with the December 15'h reading ',of thep'receding year, C. In calculating the annual adjustment the city 'Shall round off all final calculations to the nearest pert where the rate provides for cents and to the nearest dollar where the rate does not provide for cents-,," Section 2, Theity' water rates shall be held at the 2009 level and structure until further action by city council revising any such gates or structure.
