RESOLUTION N. 2010-03,, RELATING TO THE APPOINTMENT OF AN
AGENT TO RECEIVE CLAIMS FOR DAMAGES AGAINST THE CITY OF
BAINBRIDGE ISLAND, WASHINGTON UNDER R W CHAPTER 4.96
AND REPEALING RESOLUTION NO. 2001-42
RESOLUTION No. 2010-03
A RESOLUTION of the City Council of Bainbridge Island, Washington,.
relating to the appointment of an agent to receive claims for damages
against the City under RCW Chapter 4.96 and repealing resolution
No. 2001-42,
WHEREAS, RCC Chapter 4.96 requires that all claims for tortious conduct
against a local government entity shall he filed With the entity before a civil lawsuit is -
commenced; and
WHEREAS,, RCW 4.96.020 requires the governing boder of each local
govenunent entity to appoint ars agent to receive any claim for damages under RCW
Chapter 4.96;
WHEREAS5 on August 8, 2001, the City Council passed Resolution No. 2001-42
appointing the Director of Finance and Administrative Services as agent to receive any
claim for damages under RCW Chapter 4.96; and
WHEREAS, the City Council has dternmined that it is in the best interest and
general welfare of the City to repeal Resolution No. 2001-42 and appoint the City Clerk
or his/her designee as agent to receive any claim for damages under RC's Chapter 4.96;
now, therefore,
THE CITY COUNCIL of THE CITY of BAINBRIDGE ISLAND DOES
RESOLVE AS FOLLOWS:
1. Section 1, Resolution No. 2001-42 is hereby repealed.
2. Section 2, The City Clerk or his/her designee is appointed as the agent to
receive any claim for damages against the City of Bainbridge Island under ICW Chapter
4,96. The agent may e reached during normal business hours of the City of Bainbridge
Island at 280 Madison Avenue North,, Bainbridge Island, Washington 98110.
3. Section 3. The City Clerk is authorized and directed to record a copy of
this resolution with the Kitsap County Auditor.
