RES 2010-23 DECLARING COUNCIL'S INTENT REGARDING THE. REPAIR, & IMPROVEMENT OF WING POINT WAY-RESOLUTION NO, 2010-23 A RESOLUTION of the City Council of Bainbridge Island, Washington, declaring the Council's intent regarding -the. repair, and improvement of Wing Point Way, ' ' H RE S, Wing Point Way is in meed of pavement and drainage repairs and non -motorized improvements ermernt and has been listed on the Capital Facilities Plan for many years; and WHEREAS, in 2007 the City received a federal grant in the amount of $866,000 from Puget Sound Regional Council (the "Grant") towards the repair and improvement of Wing Point Way; and, WHEREAS, the grant was not sufficient to complete the entire repair and improvement of Wing Point Way, and in 2008 the City Council voted to apply the grant towards the repair of Winslow Way; and WHEREAS, City Council placed the repair of Wing Point Way on its highest priority list at a budget retreat on June 13, 2010 with' funding to be determined; and WHEREAS, on July 7, 2010, the City Council upon receiving other transportation funds for Winslow Way voted to return the Grant to alloy the City the opportunity to apply for future federal grant funds to cover the complete cost of the improvements to Wing Point Way; and WHEREAS, the City Council authorized the staff to apply for a new federal grant opportunity for non -motorized improvements to Wing Point Way, with pavement and drainage repairs to he paid for from the City's general fund, SSWM fund and/or ether funding sources secured by the City- and WHEREAS, the City Council wishes to formally declare its intent to complete the repair and improvements to Wing Point Way, now, therefore, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND DOES RESOLVE AS FOLLOWS: Section 1, The grant is returned to the Puget Sound Regional Council so that the City may apply for additional federal money to cover the cost of the non -motorized improvements to Wing Point Way, with the first grant application to be made on July 12, 2010. Section 2. If the federal grant is awarded for Wing Point Way, the City Council intends to fund the pavement and culvert repair from the General Fund, S SWM fund and/or other funding sources secured by the City, Section . 3. The City Council declares its , intent to complete repairs and improvements to Wing Point Way by December 31, 2012. Section 4. If any :section,- sentence, el'aus.e or .phrase of this resolution should be held to be invalid or unconstitutional by a court of competent jurisdiction, such imialidity or unconstitutionality shall not affect the validity or constitutionality of any other s etion, sentence, clause or phrase of this resolution, PASSED by the City Council this 14th day of July, 2010, APPROVED by the Mayor this. 14 th day. of July, 2010.
