Whenever the city uses the small marks roster for a public marks pra~ect v~ith an
estimated east belay the small marks raster threshold authorised by R
~,a4,155, a. nom existing or hereafter an~er~ded, the city shall fallow the
following procedure:
~, To ensure that a corr~petit1~e price ~s established ar~d that the public works
contract ~s warded to the lc~vest responsible b1ddr, the public works director
shall secure written ar electronic proposals from the appropriate contractors on
the raster. Proposals mad be invited fra~n all contractors on the raster.
Alterrrativel, proposals mad be invited from at least five cantra~ctors on the roster
mho have indicated the capability of performing the kind e~' work being
contracted, in ~, n~anne~' that ~~li eaiultabl~ d~strlbute the appartu~n~ty arnan the
contractors; provided, that if the estimated cast of the ~vark is $Da,aaO ar lass
fm~ ~~ and proposals are invited from less than alt the
appropriate contractors an the small works raster, the public works director shall
natif~ the remaining appropriate contractors that proposals an the mark are being
caught. The public v~arks director, at the director's option, shall notify the

For purposes of this subsection, "equitably distribute" sha11 mean that the city
shall not favor certain contractors on the srnall ~vorl~s roster a~rer other contractors
on the srr~al~ ~rorks roster mho perform sirnila~r services.

of the mark to be performed as e11 as the materials and equipment to be
furnished, Hoe~er, detailed plans and specificat~ans need not be included ~n the

procedure, the public works director shall record the bid proposals obtained far
the contract, The bid proposals shall be open to public inspection and shall also be
available to the public by telephone inquiry,
F, The public works director shall past a list of the contracts ~.arded using the
srriall marks raster at last ante a year. The list shall contain the names of the
contractors warded the contracts, the amount of the contracts, a biFlef description
of the type of cork perf armed under the captracts, ~.r~~ the d~.ta the aantracts mere
a~rarded. The list shall ~.1so state the location where the bid proposals for the
contracts are mailable far public inspection,

srriall works roster process set forth in this chapter.

appropriate cantra,ctars frorri the srriall v~arks roster,

the limited public arl~s project process, including the name of the
COrltra~t~r, the contractor's rg~tlat~an number, the anl~Unt of the
contract, ~ brief description of the type of work perfarrned, and the date
that the contract was awarded,
. For limited public or1~ projects, the public o~l~s director may ai~e
the payment and perforrriance band requirements of Chapter 9.a8 ~,
and the retainae requirements of Chapter ~a.~S R.C provided,
however, that such ~a~~er shall not cgrnprvn~~se or 11~n1t the city's right of
recovery against the contractor far any payments made by the city on the
contractor's behalf.
