ORD 2011-20 RELATING TO POLICE CIVIL SERVICEORDINANCE NO. 2011-20
AN ORDINANCE of the' City of Bainbridge Island, Washington, relating to the
police civil service and amending Sections 2.28.030 and 2.28.070 of the
Bainbridge Island Municipal Code.
WHEREAS, the City may adopt local provisions for its civil service system that differ
from those of state law as long as the City's system substantially accomplishes the purpose of
RCW Chapter 41.12; and
WHEREAS, the City Council finds that the public interest would be served by
dissolving the existing Civil Service Commission, creating a new, larger Civil Service
Commission, reducing the period of residency required for appointment to the Commission, and
having an existing city employee perform the duties of secretary/chief examiner; and
WHEREAS, the City Council finds that with these changes the City would continue to
have a civil service system which substantially accomplishes the purposes of RCW Chapter
41.12;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE
ISLAND, WASHINGTON, DOES ORDAIN AS FOLLOWS:
Section 1. Section 2.28.030 of the Bainbridge Island Municipal Code is hereby amended to read
as follows:
2.28.030 Civil service commission -Created -Composition -Appointments,
terms and vacancy filling.
There is created for the administration of such civil service for the police
department, a ,civil service commission composed of tl~r€~five members who
shall be appointed by the mayor of the city with the concurrence of the city
council. A person shall be considered eligible for appointment to the commission
if he or she is a citizen of the United States a resident of the city, and an elector
of Kitsap County. The term of office of such civil service commission shall be
s-i~four years, except that the first five members of the commission shall be
a~~ointed for different terms as follows• three to serve for a period of four years
and two to serve for a period of two ems; -an'' +''° rr ^°N+ ^~~~~' °°
ef~=^ ° ^~,^*~^r ^~' ~~°~~~^~~^~. The existing civil service commission shall be
dissolved and all positions on the commission created by this ordinance shall be
deemed vacant. In the event any civil service commissioner resigns,-or becomes
disqualified or is removed for cause under a process adopted by City Council
resolution, another commissioner shall be appointed to take his place for the
unexpired portion of the term.
Section 2. Section 2.28.070 of the Bainbridge Island Municipal Code is hereby amended to read
as follows:
2.28.070 Continuation of existing rules and regulations.
To the extent consistent with city code. Aany rules and regulations adopted by the
existing civil service commission p~n~~^ce-~8-mare deemed in full
force and effect until amended or repealed by the civil service commission created
by this ordinance.
Section 3. This ordinance shall take effect and be in force five (5) days from its passage,
approval, and publication as required by law.
