ORD 2011-27 ELIMINATING AUTOMATIC ANNUAL FEE OF STORM & SURFACE WATERORDINANCE NO. 2011-27
AN ORDINANCE of the City of Bainbridge Island, Washington,
eliminating the automatic annual fee adjustment of the City's
storm and surface water utility fees. for 2012.
WHEREAS, RCW Chapter 35.67 provides that cities are authorized to establish storm
water ("storm sewer") utilities; and
WHEREAS, the City of Bainbridge Island has had a Storm and Surface Water
Management (formerly "Storm Drain") utility since 1987; and
WHEREAS, Section 13.24.065 of the Bainbridge Island Municipal Cade provides foi• an
annual rate of increase equal to the annual rate of increase in the Seattle Area Consumer Price
Index, unless City Council determines that by December 31St of any year that adjustment shall be
another amount or shall not occur for the next year; and
WHEREAS, the City has determined that no annual increase is necessary for 2012; now,
therefore,
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND,
WASHINGTON, DOES ORllAIN AS FOLLOWS:
Section 1. There will be no automatic annual fee adjustment of the City's storm and
surface water utility fees under Section 13.24.065 of the Bainbridge Island Municipal Code for
2012.
Section 2. This ordinance shall take effect and be in force on January 1; 2012 after-its
passage, approval, and publication as required by law.
