ORD 2012-08 HOUSING KITSAPORDINANCE NO. 2012-08 AN ORDINANCE of the City of Bainbridge Island, Washington, relating to the Kitsap County Consolidated Housing Authority ("Housing Kitsap"); amending Section 2.40.040 of the Bainbridge Island Municipal Code (BIMC) to authorize the City. Council to appoint an individual to serve on the Board of Commissioners of Housing Kitsap. WHEREAS, pursuant to Ordinance No. 81-35, as amended, and as authorized by RCW 35.82.300, the City of Bainbridge Island (the "City") participated in the activation of the Kitsap County Consolidated Housing Authority, now doing business as Housing Kitsap; and WHEREAS, the City has determined that it is in the best interests of the City and Housing Kitsap to authorize the City Council to designate one of its members or appoint another individual to serve on the Housing Kitsap Board of Commissioners; WHEREAS, it is anticipated that Kitsap County and the cities of Port Orchard and Poulsbo will pass ordinances similar to this ordinance and that the Housing Kitsap Board will amend the bylaws of Housing Kitsap if and to the extent necessary to reflect the change in the make-up of the Housing Kitsap Board permitted by this ordinance and such other ordinances; NOW, THEREFOR, 'THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DOES ORDAIN AS FOLLOWS: Section 1. Section 2.40.040 of the Bainbridge Island Municipal Code is hereby amended to read as follows: 2.40.040 Board of commissioners -Appointment and tenure. The Kitsap County consolidated housing authority shall be governed by a board of se-ve~ commissioners composed of the following: A. Elected Officials or Appointees. The ole~ted members of the board of commissioners shall be the board of county commissioners of Kitsap County, the mayor of Port Orchard, Washington, the mayor of Poulsbo, Washington, and the-mbar a city council member of Bainbridge Island or such persons as the elected officials from those jurisdictions may ~~oint to serve in their place. The city council of Bainbridge Island will designate one of its members to serve on the board or the city council may appoint another individual to serve in place of one of the council members. 1. Appointment to the board of commissioners of the Kitsap County consolidated housing authority as a result of holding such elective office or being appointed shall take effect upon election and confirmation of office as a county or municipal official or confirmation of appointment. A certificate of appointment or re-appointment to the board of commissioners of the Kitsap County consolidated housing authority shall be filed with the clerk of said board and such certificate shall be conclusive evidence of the due and proper appointment of such commissioner. 2. Each commissioner shall serve on the board of the Kitsap County consolidated housing authority during that commissioner's tenure as an elected official or appointee of the county or municipality respectively, and the commissioner shall continue to serve on the board until the commissioner's successor has been appointed. 3. The city council member appointed to serve on the board or the individual appointed by the city council to serve on the board in place of one of the council members shall continue to serve on the board until replaced by the city council or removed for cause pursuant to law or the bylaws of the board. B. Participant.
