RES 2013-01 KAWAGUCHI SEWERRESOLUTION NO. 2013-01
A RESOLUTION of the City Council of the City of
Bainbridge Island, Washington, relating to the City's
approval of a minor modification to the South Island
Sewer to allow a connection for Tax Lot 042402- 2 -029-
2005.
WHEREAS, the City and Sewer District No. 7 developed Local Improvement District
No. 20, known as South Island Sewer, with agreements in 1997, 2003 and 2007 for 480
equivalent residential units, 150 of which are designated for Additional Parcels in Lynwood
Center and Adjacent "Open Space" Residential; and
WHEREAS, the City Council approved Administrative Procedure 2.14, South Island
Sewer Connections, on March 22, 2006 which defines and provides guidance on Adjacent "Open
Space" Residential connections; and
WHEREAS, Glen and Carol Kawaguchi, located at 4355 Point White Drive, Parcel Tax
Account Number 042402 -2- 029 -2005, have applied for sewer availability and connection to the
South Island Sewer; and
WHEREAS,
the Kawaguchi's property
falls
within the Adjacent "Open
Space"
Residential category
and meets the requirements set
forth
in Administrative Procedure 2.14;
and
WHEREAS, the Kawaguchi's 30 -year old septic system is exhibiting signs of stress,
which are precursors to system failure; and
WHEREAS, the remainder of the subject property is not suitable for a new septic and
reserve system due to the shallowness of the water table, presence of surface water and springs,
and proximity to adjacent wetlands; and
WHEREAS, the City has available equivalent residential units; and
WHEREAS, the City Council has determined that this request meets the requirements of
the Comprehensive Plan to extend the South Island Sewer to this address; and
NOW, THEREFORE, THE CITY COUNCILOF THE CITY OF BAINBRIDGE ISLAND,
WASHINGTON, DOES RESOLVE AS FOLLOWS:
1. The South Island Sewer of Local Improvement District No. 20 be modified to include
Tax Parcel Number 042402 -2- 029 -2005 and allow a sewer connection for Glen and Carol
Kawaguchi, located at 4355 Point White Drive, subject to the following conditions and
requirements:
A. Construction by a contractor of Kawaguchi's choice and at Kawaguchi's expense
of the connection from the force sewer main off Pleasant Beach Drive to the
Kawaguchi's residence in accordance with the Public Works Department's
specifications.
B. Recorded access and utill 13 easement m a form acceptable to the City Attorney
for maintenance of the pipe across the property to the grinder pump.
C. Decommission of the existing septic tank to Kitsap County Health District
standards.
D. Payment of the following sewer fees totaling Eighteen Thousand Eight Hundred
Thirty -One Dollars and Eighty -Nine Cents ($18,831.89):
1. $10,365.89 for Local Improvement District No. 20;
2. $5,991 for Sewer Connection, $2,200 for Latecomers Fee and $100 for
Inspection Fee;
3. $125 for Sewer Service Area -Minor Modification; and
4. $50 for Administrative Fee,
E. Inspection completed by the Public Works Department.
