RES 2013-08 LYNWOOD CENTER DRAINAGE PROJECTRESOLUTION NO. 2013-08
A RESOLUTION authorizing the purchase of a Tideflex Series
CheckMate Check Valve from Tideflex Technologies to be used for the
Lynwood Center Drainage Project with a purchase price of $24,531.00
(not including freight costs) as a sole source purchase without calling for
bids, and further authorizing the City Manager to execute all appropriate
and necessary documents to complete the purchase and transaction.
WHEREAS, Section 3.72.020(B) of the Bainbridge Island Municipal Code states that
staff "shall continue on an ongoing basis to obtain the lowest practical price for supplies,
materials, and equipment purchased under this section "; and
WHEREAS, RCW 39.04.280(1), RCW 35.23.352(9) and state law in general recognize
a "sole source purchase" exception from competitive bidding requirements when, due to the
uniqueness of the product to be purchased and the fact that there is only one source, it would be
futile to utilize a competitive bidding process for such product; and
WHEREAS, the City requires the purchase of a 48" Tideflex Series CheckMate Slip -In,
Inline Check Valve to be used for the Lynwood Center Drainage project; and
WHEREAS, for operational reasons, the part must have certain key features, including
the following:
• The CheckMate valve is maintenance free.
• The valve can be installed without modifications to the existing 48 "outfall
pipe.
• The CheckMate valve operates at extremely low head loss. This means
since the valve is installed inside the pipe, that restriction of the
mechanism is minimal.
WHEREAS, the City conducted extensive research regarding available check valves and
concluded that only the check valve available through Tideflex Technologies, which holds the
patent through its subsidiary Red Valve Company, would satisfy the requirements and criteria;
and
WHEREAS, Tideflex Technologies is the only source for the valve and is willing to sell
the valve to the City for a purchase price of $24,531.00 (not including freight costs); and
WHEREAS, the City Council finds it would be futile to call for bids regarding the
described equipment since only a check valve from Tideflex Technologies will satisfy the stated
requirements and criteria and Tideflex Technologies is the only source for the equipment; and
WHEREAS, the City Council finds that it is in the best interest of the City to authorize
purchase of the check valve from Tideflex Technologies as a sole source purchase without
calling for bids, now, therefore,
THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND,
WASHINGTON, DOES RESOLVE AS FOLLOWS:
1. The City Manager is hereby authorized and directed to purchase the Tideflex
Series CheckMate Check Valve from Tideflex Technologies as a sole source purchase without
calling for bids to be used to for the Lynwood Center Drainage Project for a purchase price of
$24,531.00 (not including freight costs).
2. The City Manager is further directed to execute all appropriate and necessary
documents to complete the purchase and transaction. The final form of said documents shall be
reviewed and approved by the City Attorney or his designee.
