i the exemption of the police chief position from civil service and
recognizing the authority of the police chief to exempt additional
positions; amending Sections 2.28.020, 2.28.050, and 2.28.060 of
the Bainbridge Island Municipal Code; and establishing an
effective date.
WHEREAS, RCW 41.12.050 authorizes exempting the police chief position from civil
service; and
WHEREAS, the statute further provides that an exempt police chief may designate
certain other positions as the unclassified service and thereby exempt them from civil service;
and
WHEREAS, the Bainbridge Island City Council desires to confirm that the position of
chief of police is exempt from civil service and to recognize the authority given an exempt police
chief by the statute.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE
ISLAND, WASHINGTON, DOES ORDAIN AS FOLLOWS:
Section 1. Sections 2.28.020, 2.28.050, and 2.28.060 of the Bainbridge Island Municipal Code
are hereby amended to read as follows:
2.289020 Applicability.
The provisions of this chapter shall be applicable to er4 all full -time employees
of the police department employed by the city after the effective date of the
o0rdinance No. eedified it this ,.haptef. 76 -15, except for the following_
A. The position of police chief shall be exempt from the provisions of this
chapter; and
B. Pursuant to RCW 41.12.050, the police chief shall be entitled to designate
a certain number of additional positions, to be known as the unclassified
service, as exempt from the provisions of this chapter. In designating such
positions as exempt, the police chief shall follow the procedures set forth
in RCW 41.12.050.
2.28.050 Employment, advancement and vacancy filling in the police
department.
All applicants for employment with, advancement in, or the filling of a vacancy
in, any position in the police department of the city covered by civil service shall
be required to have specified qualifications, have tenure of office, and be subject
to removal, as provided in the civil service regulations adopted by the commission

consistent with the law of the state, except that in the employment, advancement
and filling of vacancies in the department, the commission shall certify to the
-- appointing power the names of the three persons highest on the eligible list for the - - -
class (or the list held appropriate for such class) to which the vacant position has
been allocated, or willing to accept employment, the appointing power shall select
one of the three persons to be appointed to the available position.
2.28.060 Appointing power.

concurrence of the city manager of the city.
Section 2. This ordinance shall take effect and be in force five (5) days from its passage,
approval, and publication as required by law.
