ORD NO. 2014-02 JOINING MRSC ROSTERORDINANCE NO. 2014-02 AN ORDINANCE of the City of Bainbridge Island, Washington relating to the award of Public Works contracts and consulting services for architectural, engineering and other professional services; adding a new Section 3.70.040 and amending 3.72.080 of the Bainbridge Island Municipal Code. WHEREAS, RCW 39.04.155 and other laws regarding contracting for public works by municipalities, allow certain contracts to be awarded by a small works roster process; and WHEREAS, the City of Bainbridge Island adopted a small works roster process in 1984; and WHEREAS, RCW 39.80.030 requires that an agency publish in advance the agency's requirement for professional services; and WHEREAS, one of the ways to accomplish that notification is to announce generally to the public the agency's project requirements for any category or type of professional services and request qualification statements to be kept on file with the agency; and WHEREAS, RCW 39.80.040 states that agencies shall encourage firms that provide architectural, surveying and/or engineering services to submit annually a statement of qualifications and performance data for evaluation in connection with agency projects; and WHEREAS, the City wishes to contract with the Municipal Research and Services Center of Washington (MRSC) and' other agencies for use of their electronic databases for small works roster and consulting services that are developed and maintained by MRSC and other agencies; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DOES ORDAIN AS FOLLOWS: Section 1. A new Section 3.70.040 of the Bainbridge Island Municipal Code is hereby added to read as follows: 3.70.040 Use of Other Agency Rosters As an altern ative lo creating and maintaining the city' own annual roster ft r the procmement of flrchitecllffal. surveying, and engineerin g services, the city manager is authori zed to nter into agreements with the Municipal Research Services Center (MRSC) and/or any other agencies for use of their annual rosters , s long as su ·h r sters are in com pliance with the latest State of' Wa hingt n rul es, regulations, requirement and laws regarding pro urem nl of architectw·al, surveying, and engineering services. 1 Section 2. Section 3.72.080 of the Bainbridge Island Municipal Code is hereby amended to read as follows: 3.72.080 Public works -Small works roster established. A. A single. general small works roster shall be established. The small works roster shall be maintained by the public works director and shall consist of all responsible contractors who have requested to be on the roster, and who, where required by 0 law, are properly licensed to work in the state and in the city, and who keep current records of applicable licenses, certifications, registrations, bonding, insurance or other appropriate matters on file with the public works director. B. At least once each year, the public works director shall publish in the official newspaper or a newspaper of general circulation within the city a notice of the existence of the small works roster. The notice shall solicit the names of the contractors for the small works roster. C. Responsible contractors shall be added to the small works roster at any time they submit to the public works director a written request to be added to the small works roster and provide copies of the records required herein. D. As an altern ative to creating and maintaining the city's own smaU works roster for construction of public works proj ects, the city manager is auth rized to enter into agreements wi·U1 the Municipal Res arch Servi es enter (MRS ) or any other agencies for use of their small works roster as long as such small works rosters are in compliance with the latest State of Washington rules, regulations, requirements and laws regarding the establishment maintenance and use of small works rosters for public works projects. Section 3. This ordinance shall take effect and be in force five (5) days from its passage, approval, and publication as required by law. PASSED BY THE CITY COUNCIL this 22nd day of January, 2014.
