ORD 2015-05 CREATING AND ESTABLISHING A NEW FUND DESIGNATED AS A TREE FUNDORDINANCE NO. 2015 -05 AN ORDINANCE of the City of Bainbridge Island, Washington, creating and establishing a new fund designated as the City of Bainbridge Island Tree Fund to support future City tree related projects; adding a new Chapter 3.39 to the Bainbridge Island Municipal Code. WHEREAS, trees are of vital importance to the health, safety, and welfare of the citizens of the City of Bainbridge Island; and WHEREAS, the Comprehensive Plan and the development regulations in the BIMC support retention of trees through review of larger development permits and the planting of new street trees in the right -of -ways of urban zoning districts ; and WHEREAS, a committee of Councilmembers and Planning Commissioners known as the Tree Ad Hoc Committee has been meeting throughout 2014 to review and discuss amending the many different tree related regulations in Titles 16 and 18; and WHEREAS, while reviewing tree and vegetation regulations, committee members and City staff heard from citizens that those people or tree removal companies that violate City tree regulations should be held accountable through City code enforcement actions, including required replanting and fines; and WHEREAS, the Tree Ad Hoc Committee recommended, and it is in the public interest to establish the City of Bainbridge Island Tree Fund as the repository for fines collected for tree related code enforcement fines, regulated by BIMC Chapter 1.26 and Titles 16, 17, and 18, so that tree related fines may be used to support public trees or tree programs; and for the accomplishment of other public purposes as set out in the Comprehensive Plan; now, therefore NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DOES ORDAIN, AS FOLLOWS: Section 1: A new chapter 3.39 "Tree Fund" is added to the Bainbridge Island Municipal Code as follows: 3.39.010 Established. A special revenue fund to be designated as the "Tree Fund" is established to receive special revenues supporting the City's tree program, including efforts to maintain or increase the tree canopy on Bainbridge Island, encouraging a Street Tree program, or similar efforts, and to provide segregated accounting and control for expenditure of monies. 3.39.020 Accounting. Accounting within the Tree Fund shall segregate revenues and expenditures so that funds shall be used to support the City's tree - related activities. Tree Fund Ordinance — February 3, 2015 3.39.030 Definitions. Definitions as established in Titles 16, 17 and 18 shall apply here. 3.39.040 Functions and Disbursements. The Bainbridge Island Tree Fund is intended to accept funds from sources that include, but are not limited to, private donations, public allocations and the proceeds from the payment of tree - related code enforcement actions. The Bainbridge Island Tree Fund is intended to: A. Support the City's tree program; B. Provide direct financial and technical assistance to qualified projects; C. Provide financial assistance to public and private non - profit organizations supporting activities consistent with city policy; and D. Fund approved, eligible operating expenditures related to the provision of assistance covered by this chapter. 3.39.050 Reporting. A separate written report on the financial status of the City of Bainbridge Island Tree Fund shall be available upon request at the conclusion of each financial year. Section 2. This ordinance shall take effect and be in force on and after five days from its passage, approval and publication as required by law.
