ORD 2000-03 OFFICIAL ZONING MAP DESIGNATION AMENDMENT (COULTAS)ORDINANCE NO. 2000-03 AN ORDINANCE of the City of Bainbridge Island, 'Washington, amending the City of Bainbridge Island Official Zoning Map changing the zoning designation for tax parcels 222502-1-010-2005, 222502-1-010-2203, and 222502-1-011- 2004. WHEREAS, on June 30, 1996, Mr. Tom Coultas submitted an application for a comprehensive plan amendment changing the land use designation from residential to light manufacturing for two parcels located on New Brooklyn Road; and WHEREAS, the City Council adopted Ordinance 99-38, with conditions, on November 10, 1999, approving the land use designation change from OSR-2 to Light Manufacturing; and WHEREAS, the Washington State Growth Management Act (RCW 36.70A) requires that zoning be consistent with the comprehensive plan; and WHEREAS, Mr. Coultas filed a rezone application based on the approval of the land use designation change; and WHEREAS, the Heating Examiner held a public hearing on the rezone application on November 30, 1999, and recommends approval of the rezone with conditions. Now, therefore THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DO ORDAIN, as follows: Section 1. The City Council hereby adopts the Hearing Examiner's findings of fact, conclusions of law and recommendation dated January 14, 2000. Section 2. The City of Bainbridge Island Comprehensive Plan Official Zoning map is amended changing the zoning designation on Tax parcels 222502-1-010-2005, 222502-1- 010-2203 and 222502-1-011-2004 from OSR-2 to Light Manufacturing (LM); provided that any development of these parcels for Light Manufacturing uses must set aside as the required open space for the project, an area on the south one-half of both parcels to allow the continuance of the operation of the tree farm and pasture lands agricultural uses to maintain the scenic vistas presently enjoyed by users of New Brooklyn Road. Buildings, parking, storage and other structures included in the Light Manufacuting development must be located predominantly on the north one-half of the two parcels. Section 3. The City Clerk is authorized and directed to file this ordinance for record with the Kitsap County Auditor, and to file one copy with the recording number with the Kitsap County Assessor and the applicant. Section 4. This ordinance shall take effect and be in force five days from and after its passage, approval and publication as required by law.
