ORD 2000-05 OFFICIAL ZONING MAP DESIGNATION CHANGE (VANCIL)ORDINANCE NO. 2000-05 AN ORDINANCE of the City of Bainbridge Island, Washington, amending the City of Bainbridge Island Official Zoning Map rezoning tax parcels 102502-2-024-2001. WHEREAS, in August 1995, Mr. and Mrs. Vancil submitted an application for a comprehensive plan amendment changing the land use designation from residential to light manufacturing for a parcel located on Day Road East; WHEREAS, the City Council adopted Ordinance 99-40 on November 10, 1999, approving the land use designation change from OSR-0.4 to Light Manufacturing; and WHEREAS, the Washington State Growth Management Act (RCW 36.70A) requires that zoning be consistent with the comprehensive plan; and WHEREAS, Mr. And Mrs. Vancil submitted an application for rezone requesting a zone change from R-0.4 to Light Manufacturing; WHEREAS, the Hearing Examiner held a public heating on the rezone request on December 2, 1999, and recommends approval of the rezone with conditions. Now, therefore THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DO ORDAIN, as follows: Section 1. The City Council hereby adopts by reference the heating examiner's findings of fact, conclusions of law and recommendation, dated January 19, 2000. Section 2. The City of Bainbridge Island Official Zoning Map is amended changing the land use designation on Tax parcel 102502-2-024-2001 from R-0.4 to Light Manufacturing (LM); provided that the property owner is required, at the time of development of the parcel for Light Manufacturing use, to retain the existing forested landscape in all required boundary line buffer areas and in designated open space to preserve the forested character of the site, provide visual screening for surrounding property owners, preserve the visual quality of Day Road East and SR 305 and conserve forested areas for wildlife habitat on the site. Section 3. The City Clerk is authorized and directed to file this ordinance for record with the Kitsap County Auditor, and to file one copy with the recording number with the Kitsap County Assessor and the applicant. Section 4. This ordinance shall take effect and be in force five days from and after its passage, approval and publication as required by law. The Vancil's applied for a rezone consistent with the land use designation change. The Heating Examiner held a Public Hearing on the Vanoil Rezone request on December 2, 1999, and has recommended approval, with conditions. RECOMMENDATION Third Reading and adoption.
