ORD 2000-34 LEVYING GENERAL TAXES FOR FISCAL YEAR COMMENCING JANUARY, 2001ORDINANCE NO. 2000 ~ 34 AN ORDINANCE of the City of Bainbridge Island, Washington, levying the general taxes for the City of Bainbridge Island, in Kitsap County, for the fiscal year commencing January 1, 2001, on all real and personal property within the City that is subject to taxation, for the purpose of providing sufficient revenue to carry on the normal activities of the City for the ensuing year, as required by law. WHEREAS, the City Council of Bainbridge Island has considered the financial requirements of the City for 2001 as set forth in the Financial Capacity Analysis approved by the City Council on May 12, 1999, and the amounts necessary and available to be raised by ad valorera taxes on real, personal and utility property which are included therein and updated by projections of the City's Finance Director; and WHEREAS, the City Council gave proper notice of a public hearings held on November 17, 1999 and on November 23, 1999, to consider the City's revenue sources for the City's 2001 current expense budget, and held such hearing; and WHEREAS, the City Council, after hearing and duly considering all relevant evidence and testimony presented, has determined that the City requires, and finds that there is substantial need for, an increase in property tax revenue from 2000, in addition to the increase resulting from the addition of new property, in order to discharge the expected expenses and obligations of the City and in its best interests; and WHEREAS, in Section 1 of Ordinance No. 99-68, passed in November 1999, the City Council levied the 2000 general property taxes for collection in 2001 and stated the percentage increase in the levy from the prior year in both dollars and percentage; and WHEREAS, Ordinance No. 99-68 also provides that Section 1 of the Ordinance is null and void and of no force and effect "in the event that Initiative 695 fails to become law or that portion of Initiative 695 which prohibits the City Council from increasing property taxes w_ithout a vote of the people is declared invalid"; and WHEREAS, the King County Superior Court has ruled that Initiative 695 is unconstitutional and the Washington Supreme Court is expected to rule on the issue during the Fall of 2000; and WHEREAS, the passage of Initiative 695 and the subsequent decrease in motor vehicle excise tax and other revenue available to the City (which decrease the City now understands will occur regardless of whether 1-695 remains valid law) has placed additional pressure on the City's ability to accomplish its mandated functions with the revenues allowed to it; now, therefore, Revised 10/03/2000 Printed 10/03/2000 - 1 - THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The 2000 property tax levy for collection in 2001 shall be $4,347,521 (the amount authorized for collection in 2000) plus an increase of $260,85 1 which is an increase of six and no one-hundredths (6.00) percent from the amount the City could levy under RCW 84.55.092 and an increase of ten and eighty-six one-hundredths (10.86) percent over the amount actually levied plus an increase equal to the amount allowed under the new construction provisions of RCW 84.55.010, state-assessed properties and all allowable levies. Section 2. This ordinance shall be certified to the proper Kitsap County officials, as provided by law. The taxes levied in this Ordinance shall be collected and paid to the Director of Finance and Administrative Services of the City of Bainbridge Island at the time and in the manner provided by the laws of the State of Washington for the collection of taxes for non-charter code cities. Section 3. This ordinance shall be effective 5 days after its passage, approval, and publication as required by law. PASSED by the City Council this 25th. day of October ,2000.
