ORD 2015-26 ELIMINATING AUTOMATIC ANNUAL FEE ADJUSTMENT OF THE CITY'S SSWM FEES IN 16ORDINANCE NO. 2015-26 AN ORDINANCE of the City of Bainbridge Island, Washington, eliminating the automatic annual fee adjustment of the City's storm and surface water utility fees for 2016. WHEREAS, RCW Chapter 35.67 provides that cities are authorized to establish storm water ("storm sewer") utilities; and WHEREAS, the City of Bainbridge Island has had a Storm and Surface Water Management (formerly "Storm Drain") utility since 1987; and WHEREAS, Section 13.24 of the Bainbridge Island Municipal Code provides for an annual rate of increase equal to the annual rate of increase in the Seattle Area Consumer Price Index, unless City Council determines that by December 31" of any year that adjustment shall be another amount or shall not occur for the next year; and WHEREAS, the City has determined that no annual increase is necessary for 2016; now, therefore, THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND, WASHINGTON, DOES ORDAIN AS FOLLOWS: Section 1. There will be no automatic annual fee adjustment of the City's storm and surface water utility fees under Section 13.24 of the Bainbridge Island Municipal Code for 2016. Section 2. This ordinance shall take effect and be in force on January 1, 2016 after its passage, approval, and publication as required by law. PASSED by the City Council this 27th day of October, 2015.
