RES 2016-02 LATECOMER REIMBURSEMENT CHARGE FOR PORTION OF CAVE AVENUERESOLUTION NO. 2016-02 A RESOLUTION of the City of Bainbridge Island, Washington, setting a public hearing on a latecomer reimbursement charge for a portion of Cave Avenue. WHEREAS, John and Alice Tawresey, the developers of the Cave Landing (the "Developer"), entered into a City Standard Developer Agreement to install a water line on a portion of Cave Avenue, a public right-of-way; and WHEREAS, the Developer requests approval of the City's standard latecomer reimbursement agreement to partially recover some of the capital costs that benefit the adjacent property owners; and WHEREAS, the City provided notice of the recommended reimbursement charge and area to the owners of the properties subject to the reimbursement in accordance with Section 13.32.170 of the Bainbridge Island Municipal Code ("BIMC"); and WHEREAS, under BIMC 13.32.170, property owners subject to the reimbursement have the opportunity to request a public hearing before the City Council within 21 days of the notice; and WHEREAS, the City received a request from a property owner for a public hearing; now, therefore THE CITY COUNCIL OF THE CITY OF BAINBRIDGE ISLAND DOES RESOLVE AS FOLLOWS: A public hearing relating to the latecomer reimbursement charge for a portion of Cave Avenue is scheduled before the City Council at 7:00 p.m. on Tuesday, February 16, 2016.
